Fight it! Car #1 driver may be trying to set up lawsuits against two defendants. Stand your ground, and make sure your insurance company gets a recorded statement from the witness as soon as possible. Your attorney should get a statement under oath of the witness as well to preserve her testimony just in case she moves from the area or changes her address, etc. This is very, very important.
You need to get a copy of the police report. It will cost you about $10 most likely but it will give you proof of what the driver in fromt of you said at the scene of the accident. I was in an accident very similar to yours but it invoved 4 cars, 2 at fault and 2 not at fault. I was one of the not at fault drivers and it took 9 month to get a settlement. My car was also totaled and I got that money for my car within 2 weeks, but the lost pay, medical bills and other expenses took 9 months. Good luck.

The impact forced me into the car ahead of me, but they insisted that they were hit twice. I knew for sure I did not rear-end them first. Maybe it's some kind of weird phenomenon that they felt 2 impacts.

I was a juror on a court case last month and the plaintiff was someone who was pregnant when she was hit by someone else. She was suing the insurance company of the person who hit her and she claimed back and neck pain 6-7 months after the accident (1-2 months after the baby was born OK). Although I really wanted to believe her, I couldn't because there was NO mention of that kind of pain in ANY of her medical records. There was simply no proof, just her word.
If you are experiencing any kind of pain at all (even if you attribute it to the pregnancy) see your doctor and have the pain noted in your medical records. If you are still experiencing pain after the baby is born and that pain is from the accident that is the only way that you will get the money you deserve.

Your car ricochets back and forth. Several years ago, I was in this same situation and after the car in front of me said that they felt 2 impacts, the police officer that came to the scene explained that that would be expected.
I was stopped behind a car at a red light. A woman didn't notice the light was red and drove into the car at full speed. (Never even applied the brake, said the sun was in her eyes.) She shoved me into the car in front of me but the impact bounced her back a little. I bounced off the car in front of me, went back into her car, which in turn bounced me back into the car in front of me. It happens within a matter of seconds, but it definitely feels like multiple impacts.
DH was trying to explain it to me by way of the laws of physics, but I really wasn't grasping the specific reasons.
OP, what does the police report say? It should indicate whether you had any fault, or if you are totally clear.
debbie801--I was wondering about the richochet possibility but wasn't sure how it would work. As soon as the car behind me it me, all I felt was being tossed around ... I don't remember anything but that after the initial impact. But I do remember that the initial impact sent me flying FORWARD first, and I remember seeing me hitting the car in front of me as a result ... and I remember that I was completely stopped beforehand.
The police report I was given was only a preliminary ... the copy I take and turn in to the DMV. I called to try to get a copy of the final police report, but was told by the clerk that in South Carolina the reports don't become available until 30 days after the accident, at which time I can mail away for one from the main office in Columbia. So, I have a little while before I can obtain one, and in the mean-time I don't know if insurance companies will work with the preliminary report, or if they have to have the final report.
RobinB, thanks for the advice. I feel relatively lucky that I didn't sustain more injuries, as I've had a previous spinal injury that caused me a great deal of pain for several years. That old injury was not remotely irritated by the accident. Any other problems I've had have been noted by my doctor ... I also have a follow-up appointment where I'll confirm how I'm doing. I hope and pray that nothing else will crop up, but at this point I'm not too worried about it.
