adding name to deed

Hi all, I know I asked this a few weeks ago but never really got an answer. I want to add my grown childrens name to the deed of my DVC. I asked about this before and you all said Disney had to do it and to asked them. Well after many many phone calls to Member Administration,, they finally called back and said they don't do it.. I have to either do it myself, go through a lawyer, real estate agent, title company.. etc etc. Does anyone know anything about this or if It's something a regular person like myself can do??? Disney makes no reccomendations and gave me the name of their title company , who wants $600 to do it... (this includes Disney's $100 transfer fee) Does this cost sound right to you? Is there someway to do this myself and save some money???? Disney just said they will waive the first right of refusal and send me that and I have to do the rest... Any suggestions on cutting down the cost or know someone that would charge me less???
 
My friend got a similar answer when she wanted to remove her deceased husbands name from the deed. She later found it to be much easier than that, and it onlly cost her a registration fee at the county, but she had to do it while she was in Orlando.
 
Call or E-Mail Timeshare Closing Services, Inc. Tell them I told you to contact them. This is the kind of thing they handle on a regular basis. I don't know their fees for this type of thing but I can tell you for sure that it's nowhere near the $600 you were quoted.

Do the "children" need to be 18 or 21 to be added to the deed? I know when I first purchased DVC mine weren't old enough, but I don't remember if they had to be 18 or 21.
 

I just asked this same question, last week, and the answers I got scared me into changing my mind about adding my adult children.

If they are added, my contract becomes part of their assets. If they got divorced or filed bankruptcy, etc., my DH and I are screwed.

Unless your children have prenups that specifically exclude the item as martial property in a divorce/death situation. For bankruptcy I cannot comment.
 
Thanks for your help.... I just emailed the timeshare closing co to see what they say.... I was thinking with all this divorce stuff you guys were talking about... maybe I can just add their name on my small contract in case something bad happens and leave the large contract for me and they can wait until I die for that one.... I wanted to let them get all my discounts for annual passes etc but neither live in my house so they are not allowed to get anything.....
 
You can do it easily. I think you'll still need the ROFR from DVC which they'll give automatically in this situation. Then all you need is a quit claim deed registered the way you want it. You can easily do the deed yourself in this situation. If I were in your position, I'd contact DVC member admin by fax stating your purpose and asking for a ROFR. They MAY tell you that you don't need one but I think you will. If you do, they will provide it automatically. I'd then contact the clerk of the court through the Orange County website and ask for what you need and how much it costs to register the 2 pages. Total cost done this way less than $50. Email me directly and I can provide you some additional info that may help a little more. If you're uncomfortable with the deed, you should be able to get one done up, even a warranty deed, for $100 if you're willing to do the rest yourself. I also think DVC would have waived the transfer fee but since it appears they've done away with it, I guess it doesn't matter.

I would concur with the risk for larger contracts and having other adults added as the contract would be included in their assets for college financial aid, bankruptcy, etc. If one wants to add them but minimize the risk, an option would be to add on of 25 points then transfer just the 25 pt contract.

Spurred on by this thread, I called Timeshare Closing Service today. They charge $150 to change a deed. Much more reasonable than I thought it was going to be.

You have to send in your original deed when the change is requested. This is something I will look into when I return from vacation in a couple of weeks.

Does that include the recording fees? A big difference in this situation.

This isn't precisely accurate. Even with a prenup, if your soon-to-be-ex declares bankrupsy, you have to sell your DVC to cover debts accrued during your marriage. The court will count DVC as a family asset, and order it sold to cover the debts, regardless of who incurred the debt. Count our family as older but wiser... :sad2:

I did consider this, but will wait until after vacation to investigate it more closely. However I seem to recall that there might not be a transfer fee as it is only a deed update. In my case I would be adding a name to the deed.

Fees are based in part on the price. I think you're looking at the $40 or so range for recording. Still, it's something you can easily do yourself for minimal effort, no risk in this situation and ONLY the recording fees, a couple of stamps and a fax.

This is unfortunately true. One option you can look into if you are looking at trying to get a non-willed transfer at death is a trust. You would put the deed in the trust (separate name), which includes instructions that you own it until your death, and then it is transferred to your children. I honestly don't know too much about it (and it may be more trouble than it's worth for a timeshare), but I know it's used a lot to keep family homes and property in the family in the event of a divorce, etc., so that it doesn't pass to the "in-laws." It should also protect against bankruptcy (I think-- another area I'm not too knowledgable in), because the property is in another's name (the trust), and creditors can only place a lien on the property of the debtor.
 
When my parents got divorced and my brother died - yes - was a pretty bad year... We had to pay fees that sound like the ones you quoted to take off their names. My maden name is still on it because we don't want to pay to have it changed....

I have a 30 point contract that I think I will only add my adult children too. that way I wouldn't lose much in advent of divorce brankruptcy etc. and they still can get all the discounts... Timeshare closing want $150 for each little contract... I have 150, 100 add on and 30 addon so they want $450 for all. Said they was no transfer fee anymore??? Still looking into if I can do myself. Sent Orange C email with questions... Dean's a great help...
