?? about website and newspaper print selling

thanks to quicklabs great farmer's market shots :) i went to a local market yesterday and the new owner approached me about buying some of my photos to use for newspaper ads and a website. ( wish it wasn't the just third time out with my 40d, so hoping i have at least a few decent shots to show her:scared:)

but anyway, i have no idea how to price something like that.so anyone have any ideas?

i presume for the website i'd just give her a cd ? not that i think there would be a huge market on the photos but do i retain the rights and give her some kind of usage rights? if so is she limited on where and how to use the photos? anyone know of some kind of form i can print out for something like that?

as far as quality for the newsprint esp. usually i do resolution of 300 and don't crop anymore than i have to ( 10 mp camera). would that be good for any newprint type photos as well? is there anything in particular that is needed for a decent quality print? i've seen some photos in papers that look awful.

anything else i need to think about selling something this way ie person to person?( rather than the easy way through zenfolio or imagekind where they do all the work) any ideas or help would be appreciated. i'm going to work on the photos today and told her i 'd email her once i get them up so i figure i would like to know what i need to know before i talk to her.

also what about model releases and crowds? ie a crowd of people watching an auction and one or two can be recognized although not the focus of the photo...does being apart of a crowd make any difference as far as if you need a model release

You'll need to have a contract first and foremost that outlines the terms of your agreement. They will probably want you to sell them usage rights so that they can use the photos for their promotion without having to come back to you over and over again.

Price yourself so that you include your time planning, shooting, editing, burning and then also for the loss of profit in terms of not selling anything past what you are putting together.

You won't need model releases for anything printed in the newspaper. It's something about journalistic rights - I don't know the whole thing - but newspaper photographers don't need model releases to print pictures.

I think this is good advice. You don't want to shortchange yourself for the time you actually put into this. However, I think the "journalistic rights" chikabowa was referring to only apply to news stories. If they are using these photos for advertising, I do not think this exception would apply. I am not a lawyer, but I would check with someone that has done this before. I know Mickey88 and some other on these boards have had photos published. Hopefully, one more learned than myself will post.

this is correct, since they will be using the pics for advertising/ thus profiting from the photos a model release would be required..

you could possibly avoid releases by selectively blurring those people a little..but that might be iffy in court..


I think I have a usage form at home on my pc, I'll look for it tonight if I remember
 

My bad... I mis-read the OP and thought that some of the shots would be used in the newspaper. If that isn't the case, ignore me. :)
