If you have not closed, you can have your loan officer assist you with a denial.. It is pretty easy to get denied, your realtor will not tell you that either, and imply an EMD is done if you pull the deal.. but the truth is denials happen every day .. even the day before closing. Tell your processor, you are losing your job in a week or 2, or your short funds to clos, as you spent them.
in 99.999% of the time a denial on a loan program is reason to get your EMD back ... and you can start over. ( you will not likly get back any funds with the lender for an appraisal, but they will likely put a "credit" in your file if you buy a different home.. if you randomly don't lose your job. ;) )

What you're not mentioning is the escrow company might not release funds without a court order, and the agent that was your new bestie during the house hunting process may be no help at all once the deal starts to go bad. So it may not be quite as easy as you're making it sound.

Do you get the feeling I've been there, done that? Yep, had financing denied at the last minute, legitimately so btw, and we still had to lobby hard to get the bank to actually do it. Crazy!

Anyway, leave it to us to be the 00.001% to not get our full deposit back. Of course that was partially our fault for going the small claims route and not being prepared to argue our case effectively, although the judge was a jerk, so who knows?

That said, had we hired an attorney the end result probably would have been about the same. I'm sure he/she could have gotten our full deposit back, but then a chunk of it would have gone to atty fees.

Plenty of expensive RE lessons learned to go around.


agent is working for us but never again!! we are going ahead with the deal im just gonna have to be creative about getting furniture in the house later!

Have you spoken with your agents broker about what happened? The agent you were working with has admitted he/she screwed up and certainly is not doing his/her broker any favors by being such a ditz. RE companies rely heavily on repeat customers and referrals for their business. The broker might be willing to step up with a gesture of goodwill to help protect the reputation of their company. But even if you get nothing out of it, I think they should know what happened.

Of course that is the reason. Paying cash means no hard inquiries on your credit report and not increasing your debt/income ration.

And the fact that your lender had probably already pulled your credit prior to the car purchase if you closed a week later.
