Help and advice needed please re usa rta

Hi All

We have just returned from a fab 3weeks, but unfortunately 2days before we were due home my brother had an RTA and we are desperate for some advise as we are just hitting a brick wall:confused::confused:.

An 80yr old woman ran a red line and he crashed into her causing his car rental people carrier to be written off.

There where witnesses and the police took there statements etc to prove that it was not my brothers fault.:mad:

Unfortunatley, he needed hospital treatment as he has damaged all his shoulder which is still in a sling, his back and neck etc.

We are just so thankfull that his wife and three children decided to stay in the villa with us as he was only poping to the supermarket. We are so relived that he did manage to make it home on the date we were due to travel back to the UK, although in alot of pain.

He has been seen by a specialist today and has been told it could be several weeks before he is likely to be able to return to work.:sad1:

He did have full holiday travel insurance together with the full car insurance package through Dollar, but he has been told that he should claim damages for his injuries.

My question is can anyone help us with advise as to what to do now?????

We have contacted a few UK solicitors today who are just not interested in making a claim for personal damages with the accident taking place in the USA and we just dont know were to turn to next any help, advise, contact details etc you could help with would be gratefully appreciated.

I know when I had an accident in the UK my car insurance company used their legal dept to get me some damages - does your USA car insurance have any legal cover on it at all?

My Brother was in an accident a few years back on a jet ski, don't know the facts but he got a US lawyer to work on his behalf. In the end he gave up on the claim, said it wasn't worth the hassle. All cases are different but unless its going to be big claim I doubt anyone will be interested.

I am not sure, we took the car hire with the full insurance out with net flights, I will check.

Thank you for taking the time to reply.

We did think about contacting a US lawyer but obviously you dont really know who you are contacting other than just picking a name!!

It's just such a shame as we have been travelling to Florida for the last 20+ years and thankfully never had anything bad happen before (other than a flat tyre!!) and this happens 2 days before we are due home.

Our travel insurance includes £25,000 legal cover. Looking at the small print this is to cover exactly this type of incident - getting compensation for an injury during the time on holiday. It's worth checking through all the small print of the travel insurance.
 
there are loads of accident attorneys advertising to represent victims of crashes, it would be worth doing a google search and then phoning one of their officers, it cant hurt and at least you will know if you have a case.

I agree with your brother!

We were involved ina RTA when we lived in CA. We were hit by a drunk, drugged driver, who took off after he hit us - luckily a couple of other motorists went after him and got the license plate no. - anyway I can't begin to tell you the amount of hassle we had. It took a long time to settle the claim, we ended up going backwards and forwards to see different doctors etc. There is no way I would have done this if I'd been living over here!
