You can't get a divorce if you are pregnant?

Apparently, here in Texas, if you are pregnant, you can not get a divorce because you are not in your "right mind." What the heck? I know of someone in a situation where here lovely husband, who is not pregnant, and therefore should be in his right mind, cheated on a his wife, yet the wife is forced to stay with him until she delivers. What in the world? If a woman is not judged to be in her right mind when pregnant, why are pregnant doctors allowed to practice, etc.? Sorry but I think that law is SO wrong and that it just SCREAMS sexual discrimination.

I have/had a few women doctors for various things over the years. It never occurred to me to see one pregnant and think I should start running the other way because she was not in her right mind! :scared:

Now, I can imagine that a good reason for postponing the divorce is to deal with the child support issues. But if the child's not the husband's, what could be the holdup?
 
Ok then,...consider this....
I would not be in my "right mind" to cut his "thing" off during the night for running around on me while carrying HIS child. So, no harm done, right? No charges against me, right? :confused3

Being "with child" right now..(but very happy with my DH- no problems here)..I can be very hormonal at the drop of a hat. If that were me in THAT situation, I would be totally upset with that. Move to another state- and FILE!
 
I think most states are like this, I know it is in Illinois. It is mainly for the baby, so he/she will have the fathers name and be entitled to support.
 

aren't babies entitled to the father's support whether the parents are married are not?

and I would be ticked off to have to give my baby my hubby's name if he was a cheating scumbag, but that's just me. :)
 
A child is entitled to support whether the parents were/are married or not.
 
by the way, I don't mean to get personal about the person I was referring to. I don't know much about her situation at all. At this point I am talking hypothetical situations........as in this could be a situation. Just wanted to clarify.
 
Ok that is just wrong. What is really wrong is the if she wanted to the law would protect her to get an abortion, but not a divorice. Wrong, wrong wrong... :guilty:

BTW, my doc who delivered my 2nd child was 30 weeks pregnant herself at the time. I thought that must of been strange for her. After I told her I was pleased with the delivery and she admitted she only hoped her own went as well.

Man, i didn't realize how crazy how could've gotten while I was pregnant, I'm thinking bank robberies,not paying my taxes. Darn, I could've gone hog wild and not been responsible because I was pregnant

I know a baby is entitled to support even if the parents are not married. It goes back to being legitimate, it was made to protect the baby. I didn't say I believed in it I am just saying why it is in Illinois. I never heard that is was because the mother is not in her right mind.

I might be confused and mistaking you for someone else, but aren't you pregant now? Or did you just have a baby?

Maybe it is all my brain shrinkage from being prenant (the bab is over a year old now!) :teeth:

Sorry.....No, I'm not a troll at all. I don't post all the time....but I do post quite a bit, and definitely enough for me not to be a troll. Geez.

I have a 14 month old of my own. :) She is wonderful.

I wanted to clarify just because I learned about this law on another message board, where several other women chimed in and said it was true and had happened to them as well. I think in my OP I said it was a friend---and I just wanted to clarify that I posted mainly because I think the law is outrageous and not about that woman's personal situation.

Why would you call her a troll? She was just starting a thread. Is there some unwritten Dis rule that if you have under 1,000 posts you can't start a thread with out being called a troll? Besides, what is troll like about this thread? Just a little known but amazing fact! (amazingly dumb, but still....)

Sorry OP. Just because someone crys troll doesn't mean eveyrone is thinking it. :cool1: :flower:

I don't know about now but when I was born back in 1963 my birthmom was married but I was not her husbands child and back then even if it was not the husbands child and htey were married then the child got the husbands name....

Nope, my littlest one is already 4 yrs. Just lamenting the fact that I didn't take advantage of having lost my mind during pregnancy and get away with all kinds of misdeeds.
