Well, I served on a jury yesterday and....

even tho the defendant was guilty of his actions, the plaintiff did not proove it!!!! Without getting into a long a discussion about all the details, I feel terrible because yes, it was a fact that the defendant did rear-end the plaintiff, but the case was to proove was he any more negligent than the average driver in his actions to avoid or lessen the accident. And, no , the plaintiff did not provide evidence to show this. It was a VERY long day, I was the first juror called and the first picked, but luckily by 6p.m. we had decided the case. I just feel like no one was a winner in this case. I know I followed the law and the instructions that were asked of me, so I am at peace with that.
I feel like I missed a whole week from htese boards though;) glad to be back!

Did the plaintiff over-reach and try and prove something more then what actually happened and blow the whole thing? Or did he sue for the proper charge and just not have a good case? :)
