WDW cited and fined for monorail accident

The Walt Disney company's Walt Disney world was cited by OSHA for safety violations following the death of a monorail driver in a July collision at the Florida park.
The agencey said in an e-mailed statement today that it proposed $44,000 in penalties againest the company including $7,000 for a serious violation related to the fatality, the maximum amount allowed for such a citation.

Obviously OSHA is none to impressed with the event at Disney. If there wasn't a cap, do you think they would have been fined even more?

In relation to the monorail accident, OSHA cited Disney “with a serious violation for not providing a place of employment free from recognized hazards that could cause death or serious harm by exposing employees to struck-by collision hazards.”

OSHA inspectors said they observed three violations, unrelated to the monorail fatality, during their investigation. According to their release, “Two repeat violations are being cited for exposing employees to fall hazards without fall protection and not providing educational training for monorail employees in the use of a portable fire extinguisher. A serious violation was found as well in which a drill press did not have a guard installed.”

Of the $44,000, $7,000 is the fine for the fatality and $35,000 is for the repeat violations and the balance for the new violation. Talk about a small slap on the wrist for such a large company.

If there wasn't a cap, do you think they would have been fined even more?

1) I have been involved with OSHA my entire working life.
2) I have negotiated fines/penalties and even eliminated fines.
3) There are limits to what OSHA can fine companies.
4) Sometimes cheaper to pay the fine than correct the problem

NOTE: Trust me, there are MAY situations/conditions at WDW that violate OSHA guidelines. From personal experience, when these have been brought up in meetings or in small groups, the workers are told "management will address it", which, of course, seldom happens.

Almost any on the job accident that results in death will result in an OSHA fine. They penalized them for “a serious violation for not providing a place of employment free from recognized hazards that could cause death or serious harm by exposing employees to struck-by collision hazards.” With moving vehicles, all employees are exposed to struck-by hazards in some form or fashion.......OSHA has to justify their existence somehow.

I was surprised by the amount hazards I saw just walking around in the parks, I saw many portable fire extinguisher just sitting on the floor. How hard is it to put thim on the wall?
