The teenage girl who is taking Disney to court

Wow... thats the first I heard of this story. But I hope they don't win. You cant blame the ride for something like that.:headache:
 
Sounds to me like a case where medical bills have gone through the roof, and the family has nothing to lose by looking to Disney to help pay them.

Someone on the Podcast always says that they can't hit you for asking. I'm afraid that this is just an extreme case of that.

With a settlement or without, it's sad that this happened.
 

Chances are that family probably didn't have very good travel insurance, otherwise they wouldn't need to be sueing disney, but rather claiming the medical expenses from them.

Although I agree the restraints on ToT are very minimal, and it scares me everytime, nearly every heart attack, etc is because of underlying medical conditions, that people regularly don't know about, and sadly, Disney is the place they find this out.
 
Interesting, though, that they are not asking for a lot of money. 10,000 pounds, which is less than 20,000 in US dollars. This is literally nothing in terms of compensation. Or did I mis-read the amount?
 
Hopefully the courts make them (the family) pay for such a case.

Seems like a waste of time for the courts IMHO
 
It is very sad this happened, but she could of got the same thing from any theme park ride or even tripping down the stairs, if she had an undiagnosed condition, there is nothing Disney could do.

You can't let a few freak incidences stop everyone from doing something, if we do by that method, driving should of been banned a LONG time ago!

Being someone with a heart problem, I certainly understand the plight of her parents, but at the same time...these things do happent ToT has restraints...while minimal.....It's common sense! If you have a cardiac condition DON'T go on the RIDE!! If it is an undetected condition...I would sue her pediatrician....NOT DISNEY!!!
 
I find this amazing. First off, let me say, I feel very sorry that this poor girl had any type of health risk/issue. It is very stressful both financially and emotionally for a family to deal with a situation like this and 24 hour care is no picnic in any circumstance - plus, she is young and that is so very unfortunate.

Now, that being said, I must say - this seems to be yet another lawsuit where someone is just trying to get money out of Disney. If you read other articles on the net about this, it states several interesting items which this article did not mention.

*The "incident" occurred in July 2005 - and they wait almost 4 years later to sue?? Seems like another poster said - the medical bills are getting too high and they need the $$.
*They also claim in the suit that Disney failed to adequately warn of risks - WHAT!!!! Are you kidding me? How many frickin' warning signs do you need??!! I don't mean to sound insensitive but really????!!! Sorry but this is just infuriating.
*Oh, and nevermind that they admit that she rode the ride several times over the vacation.

Uggghhh - stories like this completely disgust me.

In the UK, it is very rare for the NHS to give anyone a heart screening for no reason. If she had been complaining of chest trouble, maybe, but otherwise there would of been no way of knowing.
 
Even with no reason, most Drs do listen to your heart every single time you go th the Drs. A good physician would be diligent if they suspected anything....Not saying it wasn't pursued I am just saying that there are several signs of heart disease that may not even indicate their is a problem to the normal eye.

I haven't had my chest listened to for a very long time, not since I had breathing difficulties as a child. I have had my blood pressure taken every time. Maybe the NHS just has different guidelines!
 
It's really sad that this happened, but it is not Disney who is at fault. If people have heart problems then they should steer clear of any rollarcoasters or rides like the Tower of Terror, which all have adequate warning signs. Plus I don't understand why they waited so long to sue.
 
Oh really? Never...Wow! The US is all over that....LOL!!!

At any rate the girl's parents should not be suing Disney over this. If the ride was faulty maybe, but it wasn't.

Yep thats true with a lot of things to do with the NHS, they can't even figure out whats wrong with me!
 
Even it's an old news, it's really alarming. They can't blame the company. The parents must take their responsibility to their child, if that's her condition, they wouldn't let the child go on the ride. :sad2:
