so Alex, this is a 'good news/bad news' kind of thing-

the good news is you won your appeal and the verdict and sentence were thrown out

the bad news is the verdict and sentence were thrown out and now the AG of South Carolina is talking of changing course with the new trial and opting TO PURSE the death penalty

Do you think the talk of the Death Penalty by the State could be a means to "encourage" Mr. Alex to take a plea deal of Life Without Parole and avoid the ordeal of a second trial?

Mr. Alex is a nut job but he acts like he doesn't want to be a dead nut job.

South Carolina seems pretty proactive on executions so that would be a consideration. if he were in a state like California that hasn't executed anyone in over 20 years and has a waiting list of over 500 it might be worth the gamble to do a retrial. it occurs to me that if someone were sentenced to death in a state that didn't enforce the penalty it could be advantageous for someone who might be a higher profile target for violence to be housed in the more secure death row facilities. Scott Peterson was never attacked when he was on death row-he had his death penalty vacated, was moved into the general population and has been attackted on at least one occasion that has been publicly made known.
