Does DVD hold the latitude to restucture the entire DVC program to a weeks based system like a lot of other timeshares? I haven’t seen/read an actual recorded deed and wasn’t sure if it specifically lists that you own X number of points, or if it lists you own X percentage of the property, which they then convert to points for use in the current program. Not saying they would convert to that (it would be foolish), but could they the way their deeds/contracts read? Just want to make sure that the biggest selling point of this program stays put for the 40 years before we sign our life away :)

I doubt that DVC would convert the system to entirely week based. There have been several timeshares that have converted from weeks to points.

Starting with Aulani, DVC offers a fixed week purchase option. The POS (public offering statement) has wording that caps the fixed weeks to no more than 35% of any specific use day.

I don't think there is anything in the contract that speaks to this issue. However, I believe that a change like that would take some major legal maneuvering and probably result in a class action lawsuit.

From my deed which guarantees me the week of marathon weekend every year :

Beginning January 1, 2018 (the 'First Fixed Use Date'), the right (the Fixed Use Right) to have a STUDIO SHOWER Vacation Home Type automatically reserved for use during Week #1 (the 'Owner's Fixed Use Period') using all of the Home Resort Vacation Points allotted for the applicable Use Year. In addition, the Fixed Use Right includes a Special Event Right as defined in the Home Resort Rules and Regulations.

Can't see how this could be done even if they wanted to do it. What would they do with all the small contracts not big enough to book a week? Buy them out?

I don't see any upside at all for Disney to convert the existing resorts to a weeks-based system. No money in it.

Good point! Not just the small contracts either. We've got a large number of points but then again it takes a lot to book a 3BR at Aulani and we don't have enough for a week.

Without the approval vote of the actual membership they couldn't do this. They could make the minimum stay 5 nights and they could reallocate where the stays were cheaper for a full week within the reallocation rules.
