My family and I were just in a really bad accident. **Update on p.12

I work in the legal field (insurance defense), and your case is TOTALLY legit. You should not feel bad at all about seeing an attorney - you should be compensated for all of your medical bills, lost wages, loss of use of your vehicle and the replacement of your vehicle. Most insurance defense attorneys are reasonable and are more than willing to work with a good plaintiff attorney, especially in a severe accident like yours.

OMG! You poor thing! It is so horrible that you and your family are going through this! I agree with everything christineann said! You deserve to be compensated considering you are not even at fault and this has hurt you financially, emotionally, mentally, and physically! Not to mention your poor dd! I really hope she gets past this soon and this will not traumatize her for a long time or anything! All of you definitely deserve your trip in Nov. I hope you will be up to going then. I hope you all feel better physically and mentally soon! :grouphug:

Since it's a leased vehicle
If you're leasing the vehicle, wouldn't the dealership/loan company have the title?

I think that is the case....We recently purchased the vehicle we were leasing and got the title then. Never actually had the title with any vehicle we leased prior. Maybe it varies from state to state tho. :confused3

Oh, no, I typed my last reply before reading all the way through the posts and see that your DD is still having a tough time.

I'm assuming that the truck driver's insurance company is the one who you are dealing with. His insurance will have to pay for everything, including your vehicle, all medical bills, any time off from work, etc. I think hiring a lawyer is a great idea! When my DH was in an accident years ago we didn't hire a lawyer and regretted it. It's not that we were going for blood, but the lawyer would have handled all the details and made it a lot less stressful for us.
 
If it's a leased vehicle you don't have the title. The lease holder has it.

I've driven that road many times and have seen some terrible accidents. Please take your dd for some counseling, she needs to get it out.

I called Chrysler and they have the title. I swear I am loosing my mind.

It was another sleepless night for all of us. DD was fighting with me all morning because she didn't want to go to school. I made her go because I am really trying to get her to live normally, back to the way things were. Monday DH and I will be seeing a therapist and we'll get a name of a child psycologist for DD.

I really don't want to live my life in fear and if I want DD to get back to her normal life then I need to lead by example. There is no way I will let what happened stop me from going to my favorite place, WDW. We really need the trip. Maybe I will feel differently about driving down when we get closer to the trip. We are going to celebrate my 30th birthday and frankly I deserve this trip!!!!

Our lawer contacted us this morning and told us to absolutely refuse to talk to anyone from the other insurance company. I just don't want a long dragged out thing. He said it should be settled in a year. I just hate reliving it, you know? I must've told the story 1000 times and I just hate reliving it. It's so hard to try and get over this when there are constant reminders and we constantly have to answer all these questions from our insurance company.
 
I feel so bad for you and your family! I would imagine that everything you are going through is so normal after an accident such as yours. When I'm having a tough time about something I tell myself that time will improve the situation. I'm sure you know this in your head, but it's hard to really believe it when you are living through tough times. And when our children are hurting it's so heartbreaking to us! We're thinking of you!

It has been a rough summer for us, but we are all doing okay. I can not imagine what it is like for you guys after reading your account and what the newspaper had to say. You all are so very, very lucky!! I hope with the help of professionals that you all will be able to move forward, as tramatic as this is for you and your DH it must be 100x more so for young children. More {{{HUGS}}} for you all. And I will tell my MIL hello for you.

Oh, please everyone always wear your seatbelts. We would have all died if we didn't have them on. And moms, please make sure your childs carseat is properly installed. Thank God ours was and DS is perfectly fine.


first off, GOOD driving, you saved your families life, no ifs ands or buts.

second, you have to not let this make you never drive again, it will realllllly mess you up, i watched some show about this lady that had a similar situation and not driving hurt he life wayyyy more than the crash.

Hang in there. You're right about the fact that you're the ones left with the massive inconvenience. Try to let your lawyer handle everything. Will the trucking company's insurance pay to get you a replacement vehicle from someone like Enterprise? (You may have to pay for it and get reimbursed.) They have special discounted rates for cases like this. Please don't let the fear of driving beat you. You have to remain determined that it won't limit your lifestyle. I had to move to the North from Southern California and wanted nothing to do with driving in the winter. I had to be determined that it wasn't going to stop me from having my independence and now I'm OK with it. (Don't love it, but can get around just fine...) We are all on your side and hoping that everything works out in the end. :grouphug: :grouphug:
