Disney has only really commented to acknowledge they know that the movie exists, and nothing more. If they seek an injunction to shut the movie down it will give it such a huge PR boost that it will bring what is just another in a huge mass of indie meh's into a cult following, and Disney knows it. As long as the movie isn't making money it seems the mouse is want to let it just run its course and die, instead of giving it the infamy that will be impossible to quell. Now if the movie becomes popular on its own and starts gaining sales or ever is up for a release outside of the indie circuit, then you will certainly see legal action, but before then it's better to let a martyr die alone than give it a rallying cry.
