I use Photoshop Elements to create my designs but there are numerous programs that you could use. I always recommend trying out a free trial before buying. That is what I did with two different programs and then I chose Elements.

As long as you are not profitting from the images and are using them for your own personal use - I do not believe that there are any copyright issues.

I am not able to do the Toy Story Legos because that is Disney but I have seen some designs floating around here with them already. I think it was Marion (RustManFan) that did them.
