Just curious: is a gift or inheritance considered resale?

I have no specific need to give points to anyone, and so far I've bought resale, so I don't think this makes any difference right now. But if I bought points direct from Disney, thus getting the extra conversion options, then some years later gave them to my son (or got hit by a bus), would the points then be considered resale points and thus no longer get the extra perks?

Or let's say that Disney takes away another perk for resale buyers, but grandfathers all the people who already have points. If an owner gives those points away to a family member, do they lose their grandfathered status?
 
As far as inheritance goes, dvc points are considered an asset that can be transferred like all others. It has been DVC's tradition to automatically approve inheritance ROFR's and not consider inheritance of direct points as a resale transaction. However, the currect contract that direct buyers sign has no guarantee and apparently DVC can change its policy at any point. When asked about this, my guide stated that DVC would be extremely reluctant to do so as so many buyers have purchased direct with the intention of transfering their contracts w/o penalty to their survivors - the pushback from any such change is something that disney is keeping in mind.

I think for an inheritance they'd really have to honor the original options, after that and including family gift's, it's up to them. As a rule they will transfer the options for family gifts but you can see how one might abuse this option. Timeshares often draw the line between family and non family even when it's a gift.
 
As noted, DVD's current policy is to treat gifts or inheritances as transferring the same rights of the transferor, i.e., if he did not have the restriction applicable to the Disney Collections, the gift recipient will also not have those restriction. In fact, the current resale restriction for the Disney Collections actually reads as one applicable to "purchasers" from persons other than Disney and thus is not applicable to a gift recipient unless the transferor had the restriction since the gift recipient takes no more or fewer rights and privileges than the transferor had.
