I've been a defense attorney for 20 years and I work for an inruance company right now. I handle cases all across the country.

I heard a lot this election aboutrising malpractice rates and the need for tort reform.

I dread seeing cases brought in certain states. those states are out of control, if you're a defendant or an insurance company you're behind the 8 ball from the moent you are served with pleadings. these are the states known for exhorbitant awards and runaway verdicts.

anyone want to guess what states I'm talking about?

if you said NY or California....

you'd be dead wrong.


my "worst offenders" are Texas and Louisiana.

We're originally from Louisiana and yes, it is a messed up state on all legal issues. It is still under Nepolianic Law (has parishes instead of counties).

You are right that insurance rates are out of control there. Everyone is looking for an excuse to sue you. We refuse to drive into New Orleans because of the people that cause accidents just to make money. Yes, there is an evil underside to the law there (and some of the unethical lawyers pay these people to cause the accidents so they can sue the insurance company of the honest person).

I agree -- it's an issue for the states that need it most -- like the two I mentioned, as well as a few other states -- like Alabama and Mississippi.

did you know there's no "class action" statute in Mississippi? a defendant in a mass tort case can find itself litigating 60 or 70 different suits with potentially different outcomes.

it's no wonder that plaintiff's atorneys go forum shopping for southern states if they can find proper venue there.
