I agree. Although I really want her on death row.... BUT, I would accept LWOP, I just don't want a chance that she will get out at any time!

I watched Simpson's video too ... It made me shiver ... She was quite scary indeed ... I've read some of the other stories on what death row/life inmates' lives are like serving their sentences at Perryville ... It's hard to explain, but even though those accounts made it sound like complete and utter hell on earth to me, somehow, Simpson's interview drove home the reality of it all 100 times more ... I don't know if that even makes any sense because it's hard to put into words ... I just know that it left me with chills running up and down my spine, that's for sure ...

That Angela isn't as scary to me as Jodi, I guess I appreciate her honesty and rationale much better than the ever changing never ending Jodi stories.

And maybe Willmott should use what I would call the Simpson argument and say to a future jury of Jodi's case, in that case (Simpson's), she got LWOP so give Life to my client (Jodi) and allow the judge to decide. I'm not sure she (Willmott) would be allowed to use that argument.

And in regards to this bailing bruhaha, I don't think the jury bailed, hell, they came to a verdict that they could not agree on a verdict of Life or Death.

I don't think Jodi will take a deal. She would take her chance on a second jury or that the judge will give her a lesser sentence where she could walk in 20 yrs.

but if the jury is considered smart enough to be able to decide a death sentence, then why can't they also decide on LWOP?

WHy is it that if they choose a life sentence, that it is then up to the judge to decide LWOP or 25 to life?

It would seem that the jury should be able to decide whether it's LWOP or not.

Personally, when there is a death penalty going on the jurors really need some kind of class instruction to help them understand the phases and what the instructions really mean.

You may be right, if so I apologize for the mistake. DP really needs a solid instruction so people understand. For some people reading an instruction may not be fully disclosed to them to understand the full meaning of it.

The jury can sentence the defendant to death or to life in prison.
BUt if the jury unanimously chooses to sentence the defendant to life in prison, it then goes to the judge to decide whether to give LWOP or 25 years to Life.

She'd take the deal if it was Life with parole consideration after 25 (with 5 served) if she could get it, but I'm fairly certain the State won't offer that!

If there is a problem with a juror why did she not inform someone? Like I said he sounded like a bully.

I wondered the same thing. It's makes NO sense to be able to give DEATH but not to be able to give LWOP. Earlier in this thread, I commented that as a juror that wanted the DP I would have been willing to compromise on LWOP but not on Life because that might mean she only wound up with 25 years.

No, that wouldn't be a deal for the state since they know she'll get that at the very least regardless. In her case, she has to worry about the DP. I would LOVE to see her agree to LWOP, but I think you're probably right. I think she still thinks she may be able to get out with 25 years with a new jury.

I don't think this judge would give her Life with possibility of parole.

Anyone know of any serious cases in AZ where a judge has given Life with possibility of parole after 25?
