Penalty phase...what will the jury decide? (1 day poll!)

  • Death

  • Life (judge will sentence within 60 days, LWOP or Parole in 25 years)

  • No unanimous decision...new penalty phase jury will be empaneled.

I guess the tough thing for me to understand in reference to the juror hold outs for the DP is that there was a body, it is understood how Travis died and the cruelty that went along with it as well as a confession from someone they all appear to agree is a liar and not believable in reference to the domestic violence claim and self defense claim.. So what change to the facts would it have taken for them to vote DP? That she is not a serial killer? Well clearly the state of Arizona was well within the legal rights to charge her with a capital crime. The state can't just charge anything without merit, plus a grand jury agreed with the charges based on the same evidence.

I would think it would be tough on a jury if there is no body or confession etc but this seemed to have been a really obvious case especially when she rambled on and on for 18 days and it was obvious that the DT was throwing any and all claims out there to see if any would stick.

ITA ... However, the only thing I have come up with is that the 8 who voted for death felt that the aggravating factors outweighed the mitigating factors ... And the 4 who voted for life felt that the mitigating factors outweighed the aggravating factors ... Personally, I feel that JA has no mitigating factors whatsoever, however, apparently, others do ... It just all boils down to a difference of opinion ... :)
 
I don't think it had anything to do with mitigating factors- I think, as the foreman suggested, they just couldn't sentence a young, pretty, articulate girl to death.
 
I am over whelmed with the fact that this man fell for Jodi, hook, line, and sinker. I think he was viewing the internet. He did not follow the judges instructions. Makes him just as bad for not being truthful. Death threats are not acceptable no matter what. He was not faithful to the rest of the group. He went off on his own with the interview. He should of expected this to happen.
 
Good points, and maybe Juan will play the interview where she said that no one has to fear her being out on the street unless they threaten or abuse her...

Which interview was that? One of the recent ones? That is a disgusting statement to make and the jury foreman should be glad she didn't get her hooks into his son that wrote the facebook letter..
 

I can't remember the guy's name but I think it was the guy from AZ central- the same guy that did her post- conviction interview.

No, this alternate ( @tarakelley320) can't seem to stop talking, my goodness, she's quite chatty and it looks like Dr Drew's people probably told her to not say too much, save it for the big Tuesday night interview coz she keeps telling everyone to tune in.

JM is not going to take the DP off the table unless he is pressured by the DA to do so. So let's assume that he moves forward with a new trial that most of the talking heads agree will be about 2 weeks with fresh jurors. I am thinking that a DP verdict will happen as long as they find 12 people to serve, because in 2 weeks they won't "bond" with JA and they won't become as numb to some of the more shocking details of the case as the original jurors did. That's what I am thinking and hoping for..

I honestly think the State will proceed with a new penalty phase trial, (I was just thinking that maybe they shouldn't) ... However, I think a new trial will last longer than two weeks ... There is a lot of evidence that has to be presented to a new jury and get them up to speed with ... And then we can't forget how the DT likes to talk and talk and talk, and file motions, and ask for sidebars, and take a few days off for migraines :rolleyes: ... And that is only IF the DT stays in tact ... What if they ask to be removed from the case again and it's granted? ... That's a whole new can of beans ... Then new lawyers will have to be found and they will have to review and learn everything about the case, etc ... Oy, this could possibly take a lot longer than anyone may expect :scratchin ... Guess time will tell ...

Being young, i.e. her age, was a mitigating factor ...
 
I believe that was the first one listed, wasn't it? That she was only 27 at the time of the crime.

It was either # 1 or # 2 ... I think I remember the first two mitigating factors were: she was only 27 and she had no prior convictions ...

Yes and no criminal history. :rolleyes2 With that logic everyone should get off their first offence no matter how heinous the crime. :sad2:

No one should receive death threats for doing what they are asked to do (foreman/juror) As a previous poster said, the Judge sealed their names and addresses for a reason. But people would probably found out who they were anyway. Though juror #5, has not been bothered because she didn't go on multiple news shows and give interviews.
