I'd be curious to know why the defense entered a not guilty by reason of insanity plea. I'd also like to see more information about witness testimony. I haven't seen any articles that have statements from witnesses. I've read articles that state the cop grabbed Nelie from behind and a scuffle ensued. The cop says one thing, Nelie says another. Somewhere in there is the truth.
Yes the cop was severly injured, that I won't dispute, or condone that he was attacked during the arrest. However, given that Nelie does have Aspergers, is it possible that he refused to give his name because he might have been instucted to, "Never tell a stranger your name."?
The reason I bring this up, is that my nephew is an Aspergers teen. I'll give an example of what I'm trying to point out.
My sister and brother-in-law instructed him years ago (like most of us do with our children) to never tell a person who telephones the house that he is alone. He was told to say his mother or father can't come to the phone and they will call back.
When I call, I always chat a few minutes with him, then will ask for my sister. I'm his Aunt. He knows who I am and who he is speaking to. Yet, I always get told, "Mother can't come to the phone right now, she'll call you back." If I ask him , "Is she out shopping?" I get the same response. My sister has tried to get him to understand that he can tell me, but I guess what is firmly stuck in his head is the never tell anyone. He takes things very literal.
Again, I think we as a society and law enforcement are going to have to examine how to deal with and handle these types of situations in the future.
