If I've rented DVC via a "middle man" can I sublet to someone else?

Hi all!
-I've rented points several times, but without boring you all with extraneous detail, I've decided that the studio I rented at the Boardwalk might be a little smaller for my Dad and I then is desirable. I am an AP & see that I could get us a 1 BR for a pretty decent price direct from Disney w/an AP rate, so am considering snagging that and trying to rent my preferred studio booking. I know the rental place won't do anything for me, so I doubt this is doable. Just thought worth asking if anyone else has experience with this kind of thing.

Not without the approval of the owner you rented from.

Basically, since the owner is still responsible to Disney for your behavior, and has to be the one to change names on a reservation, they need to be involved.

Yeah, that's what I was thinking was likely the case. This is when one wishes they HAD rented directly from an owner and not used a middle man. sigh.

Most owners wouldn't allow it, either.

Contact your rental agency; see if your owner will do it (they are the ones that have to do it, the agency can't).
 

You should have some sort of contract with the broker. Check in there for any sort of restrictions on changes.
 
Definitely check with the broker. OR see if you can get the reservation changed to a 1BR and pay the difference?

I think the 1 bed is a cash reservation not points.


Op are you concerned about the physical space, or about the 1 bed and 1 sofabed?

My cousin and I shared the space at bay lake no problem, and we know each other way less than a father daughter. It worked fine. If I liked my dad and traveled with him I'd just give him the bed and take the sofabed and it would be fine.

My son, cousin, best friend, and 70+ year old aunt have all said that Disney sofabeds are quite decent and perfectly comfy.
 
The contract I signed with Dave several years ago to rent points from another owner stated that the primary name on the reservation will not change. Check your contract with your broker.
 
If one of my renters wanted to sublet I MAYBE would do it but only by keeping my original first renters deposit till after their sublet guests finish their trip. The new guests will need to pay total up front. Since they want to sublet I will use their deposit money incase of any damage by their sub letter. When all is done and good I will return the first renters deposit 10 days after trip.
Is this too harsh?
 
I guess either I have been lucky or just way too trusting. I have rented my points out for years and have never had any damages or bad experiences. Unless we personally know the people we are renting to (and even then that could be questionable) how are we to know the people are not going to take care of the room.
I have always had a rental agreement signed and in this case, I would amend that agreement so the original renter and sublet renter are both responsible for damages (if any).

But, you are still responsible to DVC and then you would have to go after the renter. Seems like a lot of hassle to me, and who knows if you would actually get payment for damage.
With friends/acquaintances who have rented points from me, I have a strict "no sublet" policy. Any borrowed points used for reservation had a nonrefundable, upfront deposit. Another other points, I am happy to refund, if I can still bank my points. I will also rebook, if there is availability.
For PP, I think allowing sublet and holding deposit is not too harsh.
 
Thanks to all who replied - sorry for the delay! I've been to Disney and back again and with all the Christmas goings on have not been back to the boards until now!

Sadly, the agreement clearly indicates that the lead guest cannot be changed so I am stuck with things the way they are. Not the end of the world and I'm sure we'll be fine - just would have been nice to have a little more space, but it is my Dad's first trip so I'm sure we will keep ourselves quite busy and not be in the room a ton.
