I got so many compliments on the altered Mouse ears that my daughter and I wore on our recent trip that I decided to make some more to sell on ebay. I bought 11 pairs on ebay for a discounted price and now I am going to alter them with glitter, feathers etc.

First up is a bridal one with a veil and Swarovski crystals. Disney sells 2 different ones I believe and they are so generic I figured some brides might want something a little more fancy.....hope so!

This. I can't imagine how this wouldn't be a lawsuit waiting to happen. Disney certainly pays attention to both this board and ebay. You should reconsider (though I love your idea).

OP, i think your idea is great BUT as the poster wrote above, Disney does watch. 1 DISser designed tshirts andDisney shut her down. Another woman made Disney machine embroidered designs and Disney sued her and took her machine as part of the settlement. It doesn't happen often but it does happen.

While I absolutely love them-especially the second one-you're using copywrited ( copywritten? wrote??) images. I'd be worried they'd contact me.

Now, how the heck did you get all that glitter on the ears??

I think the issue is that when you make these things for yourself, you're not profiting off anything Disney has trademarked. It's when you make them then try to sell them and possibly make a profit, that Disney gets their lawyers involved. I'd tread very carefully. Though what you made is beautiful!

I love it ! Did the glitter fall off and get in your eyes or worse contacts. That is the only thing that I would worry about if it were me. :rotfl::rotfl:

They are nice but not worth being sued by Disney, and they will find out about it.
 
Cant share all my secrets it took a few tries and misses to get them to work but the glitter does not fall off.

However, any Vinylmation fan knows that countless, independent, artists use the "Create Your Own" Vinylmation blanks to make their own Disney creations and sell them for $100's of dollars. This has been going on for years, and none have ever been "shutdown."

I've seen custom Tron VM's, and countless other Disney characters, without any sort of repercussions. So, somewhere there is room to negotiate these waters legally.

The fact that people get away with it doesn't mean it's legal. Disney is know for being very vigilant about protecting their copyright, but it's impossible for them to find and stop everybody. You just have to decide how much of a risk you're willing to take.

That's why I posed my question, though. If they were that vigilant there wouldn't be 50+ active auctions (not counting those that have already sold) of custom Vinylmation featuring Disney characters on them. It's not that difficult to find them on eBay. So, something tells me that what the customizers are doing is legal in some sense.
