High in the Sky Seuss Trolley Ride

I know in past trips I have seen small children on this ride, and according to what I could find in the FAQ the minimum height s 34" (which agrees with what I remember). However on the Universal site it states a 40" minimum for this ride which means my 3 year old grandson (who is 38") CAN'T go on this ride when we're there in November, BUT he CAN go on Pteranodon Flyers? Doesn't seem right to me. Did something happen on this ride that changed the requirements?

Not sure what caused the change, but it is indeed 40 inches now.They changed it a few months back
 
It probably has something to do with the restraints.
 
I noticed the change too. Last year my DD5 rode the train and it was her favorite.She was only 38 inches last summer. Luckily she is 39 1/2 inches tall now and we aren't planning to go back till maybe August 2014. We were waiting till she was 40 inches so she could ride certain rides at WDW. My DS3 is 36 inches now, but he is developmentally delayed, so certain rides he is not ready for.
 

I know that the uk 's theme parks recently had to review their height restrictions according to new rules maybe the same over in the USA shame as not much for small kids as it is x
