Giving part of DVC timeshares to relativies

I now live in Florida - so don't have to go through DVC to change this. DVC charges $450 for this service.
Now do I really need a real estate lawyer to do this?

You can just re-deed, you need to file the paperwork with the county and DVC.

okay still have the papers from DVC - so redo the deed only and then take it to the county?
 
All transfers must be submitted to Disney for ROFR. If it's a gratuitous transfer, they should waive immediately.

They won't if it's a gift to a family member. If it's a sale, even at below market rates, they will likely take it.

If you've got the transfer info from DVC, just submit the first transfer form and spell out it's a gratuitous transfer. That should ensure ROFR waiver and that any pending reservation won't be canceled. You could also add them to your name if you wanted giving them access and benefits. After you get ROFR waiver you'll need to record that and a new deed (with TWO witnesses, notarization doesn't count as one of them). Total cost should be $37 total in this situation plus the doc stamps. It's really not difficult.

my problem is finding the book and page I need on the part (VWL) that I am changing. Now both I and occompt.com orange county have the mortgage - but the final deed where the information is in my name - I don't have and neither does orange county.

I did not say that who I was transferring to is a relative (my nephew). Doing this now - because now live in Florida and day trips are fine for me - though about selling some of it - but my younger relatives wanted it and they can use it.

after OKW and having to sell my 190 points for less than my 50 points at the same resort. Demanded that they give me smaller contracts with BLT my agent (she was great) had to go to her boss - to see if I could. they say yes - so even BLT is in smaller contracts - and that way I could to my nephew and my niece give them separate contracts. they don't share well.

My niece does not have the money that her brother does. So I am keeping her share until she wants it. Told them they would have to take over the fees when the transfer was done.
 
I assume the mortgage is paid off, it has to be to transfer or you'll have to get a waiver from the mortgage company and I'm not aware they've ever done that. If it's gratuitous it shouldn't be difficult to work through this, if it's not gratuitous just put the parameters involved.

The deed has to be there for WDW, you'll just have to change your variables until you find it. Go to the page you referenced, official records search and put in the dates and Last name, First name under the area that says either party. You may need to change the qualifiers to wildcard in case they have a misspelling or similar.

thanks will kept trying - but so far it is only finding the 9 - most of which are mortgages which were paid off years ago - and the 3 BLT contracts - can find the mortgages on VWL and BWV - but those were paid off long before I brought BLT?????

There are some who are far more adept at combing through the site than I am. Maybe someone can reach out to you privately and help you find them.

It is very strange. have written to administration at DVC and so far have heard nothing. on the site there are far, far, far more mortgages than deeds and considering on this site more people have paid in cash - that seems very strange to me.

I'd call orange country registrar and/or DVC admin since you can't find them.
 
Orange county says on their site they can't help. and have emailed the administration at DVC - so guess just have to wait.

I'd call both rather than trying to do email. You said the mortgages were paid off, did you find the satisfaction of mortgage recorded? I don't recall a situation where the deed wasn't there for a retail purchase but I suppose they could have held them if there was a mortgage. The deed really is just a marker of the membership anyway, they could and likely should have done it as a trust.

You do need to find the deed, but the mortgage lien and satisfaction should help. They should reference the document number or book/page number of the deed. You can use that information to search for it.
