I'm a buyer. I did a buy it now for an item that ended up costing around $29. After a week no response from the seller and no product. I sent a nice email asking if they would please let me know either the item has shipped or when it would ship.

I got a strange message back saying an emergency came up and he was at his friends in seattle. The message was written in horrible english. He went on to say how he just now was accessing emails and was getting negative feedback and people have emergencies and need to understand and be forgiving. He promised the item would ship this week.

I sent an email back saying I had not left negative feedback and as long as he ships this week I won't. I asked to please confirm once the item is shipped.

Still nothing. No response.

When I purchased the item I was forced to pay insurance.

How can I get my money back? The seller is getting tons of negative feedback now. He keeps responding he had an emergency and will ship "next week" which is this week.

What do I do? Do I alert ebay? Can I get my money back?

I have never left negative feedback. I've gotten ripped off twice before but considered it my fault for not really researching. Once I bought a "Tag" watch that was a total fake. The other I bought dockers and they came very stained. I mean nasty stains. This time though I don't have anything.

I would alert E-bay to the situation. It is wholly possible that, yes the person is having trouble, but then again, it might not be. If you have waited at least 14 days, and have sent good faith e-mails, then you should send that information to E-bay and they can step in.

While emergencies do happen, I would try to obtain the seller contact information directly from eBay. You can do that here:
http://cgi1.ebay.com/aw-cgi/eBayISAPI.dll?UserInformationRequest

If you cannot reach them by phone, I would file an "Item Not Received" Dispute with eBay. You can do that here:
http://pages.ebay.com/help/tp/inr-snad-process.html

If you paid via PayPal, you'd have to file the claim here instead:
http://www.paypal.com/cgi-bin/webscr?cmd=p/gen/protections-buyer-outside

Good luck. If you read through the different links it will tell you the time frame in which you should file the dispute/claim so be sure to follow those guidelines.

Sorry to hear you have had such bad luck, there are decent sellers out there and it sounds as though you have gotten the bottom of the barrel in your other 2 deals, Hope this one turns out better!

Thanks for the info!

I have had many positive transactions too which far exceed the negatives.

Oh good, I thought you only had the other 2 where you were ripped off and was hoping you wouldn't think eBay was all nasty sellers, lol! Hope the process works for you! :)

I'm on the opposite end of this problem. I sold two items friday and sent each buyer an invoice. I haven't heard anything back from either one of them yet. How long is a reasonable length of time before I email them with a "friendly" reminder? :confused3 Both buyers had great feedback. I did sell some other items that day and I've already been paid and shipped the packages, so I know ebay has my correct email address. Hmmmmmmmm........anyone have any advice? :listen:
