I am a woman :sad2: and I don't think anyone called you an "idiot" for missing the e-mail. I was just trying to give you an example of why you should NOT have it automatically delete and why you should NOT depend on someone else to let you know when to expect something via email (and would THAT notification have missed your spam, too?) It's simply an e-life lesson. I get the point that their customer service completely failed and they seemed careless in their generic responses and you certainly should do something about that. Just a little friendly FEMALE advice...

Turns out Supervisor # 2 called back and said that the Title Co. is hand delivering the check today, and he will personally take it up to accounting so they can process it. They do in fact have to refund it to the actual card

whatever- it should take "36-48 hours" for that to get back on the card. If I don't see it by Thursday I should call the bank to check, and call GMAC if there is still a problem.
In the meantime- I was told to wait "36-48 hours" So I will do that.
Should be checking my spam folder every 30 seconds just in case my money gets sent there??? It's obviously a mystical place where important things are sent all the time without my ever knowing. :lmao:
 
I have read most of this, while I definately don't think your an "idiot", I also think in general if you need a more personal touch to buying something, you either go to the TSS (which I think is the largest reseller) or go direct to DVC, pay the extra $$ for the customer service(though no company is perfect). I feel they should only have to call you if you DON'T pass ROFR, because if you pass, then the docs would be sent out. Sure it would be great if they could call you every time something happens, call when docs are received, call when submitted, call when approved, etc., etc., but the manpower to do that, plus if they have to leave a message, then you call back, it would take forever. If your in the midst of a transaction, all e-mail should be looked at, especially if you said you wanted to receive the docs by e-mail? I check my spam filter daily, sometimes whenever I log on. It's not perfect. It actually blocked stuff from my mother at work!! (hmmm - maybe it does work ;)!!)

Credit to cards especially for real-estate transactions take forever, not sure why, but it does. The charge goes on immediately, but refunds forever!

Bummer the sellers messed up the points, good luck on your next attempt.
 
Sounds like poor customre service we all of come to expect....
All companies have people working for them that are not the most informed.

I would call you CC company to verify the refund before calling again as teh online systems in general are at least a day behind... they can also let you knowif it is being held.
I do not think that this is completly GMAC fault or yours it sounds like a person was misinformed and the title company did not communicate correctly not good customer service on GMAC part but I also do not think it represents the company as a whole as you did find someone with knowledge and sometimes that takes a while with any company.
although I would look at other companies I bet if you find another contract with GMAC they will give a more informed agent.
Personally I thought about a smaller contract and decided it better to deal with Disney and since have done some add ons as my initial 150 points was not enough
Good luck and if they do not give you the refund dispute it with the CC it will save you a LOT of headaches

Not every 30 seconds, no, (no one ever said that, incidentally, a little overreacting here?) but to delete it automatically without scanning it is just not, well, wise, in this day and age. Yes, important things DO go to spam all the time, obviously, by your own admission, without your knowing. An email from my travel agent just went to my spam folder this morning. So, word to the wise...don't automatically delete spam. Skim over it once a day and then hit delete.

If, on Thursday, your credit isn't there, file a dispute with the CC company. You will get a provisional credit so your money is back working for you, usually within a few days, and then it becomes between the bank and GMAC and you don't have to worry yourself about it anymore.

Hey - I understood your problem right from the start. And I'm a woman, too! ;)

Way back on what, page 1, I said to do this. I wouldn't have messed with this over and over with GMAC. I'd let the credit card company go to work on them. I wouldn't feel the obligation or necessity to hold hands with GMAC and force them through the refund process that they can't seem to understand and get straight the first time. OP, you've been more than patient with them.
 
They took a credit card for the balance of the contract because it was a small contract. Which is also why, In my opinion- why I'm getting crappy customer service.

The thing of it is- for the LAST TIME
If the agent handling the sale called me on the phone, LIKE SHE SAID SHE WOULD, when we passed ROFR- I would have known the the closing documents were going to be sent to my address, and therefore I would have known WHEN TO LOOK FOR THEM so that they weren't automatically deleted. The e-mail folder empties itself. NOT me. But give it up already.
I'm not sure this is accurate. You might have had a better idea when to look but it's likely the agent would not have known or at least thought to tell you the documents would come by email. I recently sold a contract and I don't believe the agent (a very well known and respected one who I think did a great job) told me to expect them by email and the closing company didn't let me know other than by email which did BTW, go to the junk folder as well. As for the junk folder settings, I've yet to see one where the timing couldn't be changed that was this short. Some of the webmail options can't be changed but they are a much longer timeframe. You should really change it from 3 days to maybe 30 just for reasons such as this. BTW, how do you know the agent didn't email you and it too went into the junk folder?

A few years ago I bought a BWV contract simply to get home resort priority there. The way I knew we had passed ROFR is I got the closing papers by email, again in the junk folder if I recall.

I think we all got the point from the OP. Many of us simply believe that a PORTION of this was not under the control of either the broker OR the separate closing company. That you had unreasonable expectations on the refund and that you did receive the closing papers and didn't note them through NO fault of either of the companies involved. When things happen it's not always someone else's fault sometimes things just happen, in this case some was, some wasn't their fault.

So the Title company hasn't even gotten it back to the broker yet so they couldn't have refunded it until they received it back.
 
I could have written the 1st part of this message, as it perfectly describes my recent purchase experience w/ GMAC and the same title company.

I just wanted everyone to read about this. GMAC was recomended to me here on the disboards and I just wanted to tell anyone interested in buying a resale that I believe- from my horrifying experience- that it is a mistake to do business with this company.
I will spare the long drawn out details here, (OK no I won't) but the two primary reasons for complaint are:
1) My agent told me she would call me the moment we passed ROFR.
She did not. Not only did she not call me in a timely manner- she did not call me at all.
Meanwhile, I am waiting anxiously by the phone, wondering why my contract is taking so long. Did we offer enough per point? Is the contract so small that Disney will just snatch it up anyway? After the requisite 30 days to pass ROFR came and went I contacted my agent to see what the problem was.
Turns out the contract had passed close to two weeks ago without my knowledge and the closing documents were sent to my e-mail from the title company. Because nobody told me to look for them, and because the closing docs were sent from an unknown source, they went to my junk mail folder which empties every three days.
GMAC: "Well, we sent the closing docs to your e-mail"
Me: "well I dont have them"
GMAC: "but we sent Them"
Me: "yes but I sincerely do not have the documents and I would like the documents, so..."
GMAC: " I will call the Title co. to make sure they sent them"
SO the back and forth continues with the main concern NOT being that I get the documents, but that I know they were sent to me before. I was ticked off about this, but I wanted to get the documents signed and returned because this was starting to take way longer than it should and I was excited about my purchase.

I used a perfectly pleasant gentleman who will remain nameless. He was always happy to hear from me, but I got the impression that the moment we hung up, all thoughts of me and my pending contract fluttered right out of his head. I had to micromanage the heck out of the deal once we got to the bottom of the missing emailed closing docs. I will soon be selling my BCV pts since I just bought OKW pts and have decided I will NOT be using GMAC to sell it.

Sorry about the crappy service. I hope you're able to find an acceptable contract soon through a company with better service.
 
I haven't read through this entire thread yet, but I wanted to jump in and say that I am truly sorry that you had such a horrible experience with GMAC. We had quite the opposite, and I would truly recommend them. Our agent was very helpful, and always answered questions via phone or email when I contacted her. Our first contract did not pass ROFR, but they helped me find another one and that passed.

I think it is unfair to generalize a company based on one bad experience. We started to use TTS based on DIS recommendations, but the agent who I spoke with never contacted me regarding newly available contracts, and I would later see them on their website for sale. My husband contacted a different agent at the TTS, and he heard from him all the time. In the end, we chose the best contract we could find, which happened to be with GMAC.

Well...that's because you finally took public action by complaining on the DISBoards!! ;)

Actually, I'm closing with GMAC now on a purchase (b/c they had the contract that I needed). But I would never use them to sell a contract b/c of the $195 admin fee.
