So, I am single with 2 minor children. In titling the deed, do I want my DVC contract to be subject to probate or not? When I update my will this year I will be willing the contracts to my children. I'm pretty sure I want to choose 'tenants in common'. Anyone have advise? Thanks.

With so many variables such as minor children involved - it is best to take the advice of your attorney who will be educated on your state laws. We keep putting off drawing up our wills. Definitely on the "to do" list for this year, though.

Being real estate, you can will your contracts to your children, right?

You can will property to minor children, but they will have guardians appointed who will handle their affairs till they are of age. This will vary by state law as far as the particulars.

Thanks for the responses. As to the choices on the paperwork, there is only one for a 'single' owner, so I'm set now. :thumbsup2
