Company used in school fund raiser not delivering goods

Has anyone ever encountered this?

My youngest DS's senior class had a fund raiser the end of Jan (popcorn). Money earned was to go towards their senior class trip. Money & orders were to be turned in by Feb. 3rd.

I still have not received the items ordered. I have e-mail & called the senior advisor several times. The last time was thru e-mail on March 30th. In that e-mail I was told she was calling the company that day.

Yesterday I tried calling her to check the status. No response. I decided to take it to the next level and e-mailed the principal. I really hated to bother him with this but enough is enough!

Today I got an e-mail from the principal stating the advisor is sending letters out shortly. They are having trouble with this company and will not use them again.

Has anyone ever gone thru this? Is the school responsible for refunding all the money if the products are not delivered?:confused3

I have never heard of that happening, I can't imagine how a company could lose an entire school's order. I hope that it gets resolved.
 
If enough people were defrauded & the amount of money lost is enough and if folks used the US Mail, then this could be a felony and it could even be a Federal crime.

I guess I don't think the school should necessarily have to refund the money...

Maybe (if it doesn't jeopardize getting everyone's money back) you should think about sharing the name of this no-good company with all of your 200,000+ DIS friends ::yes:: ...

Sounds likely this will have to be resolved in court. I'd guess it's too large an amount for small claims to boot.

What about your local news station investigative reporters? If the company starts getting contacted by media outlets, they may just cough up the merchandise or the cash refund to make that go away.

Did they file for bankruptcy? If so, that may mean they would be off the hook for fufilling orders, or returning the money.

Well, they sure had an easy time, taking everyone's money. And then they spent that money on *something*, apparently just not to get the items the fundraiser bought into the hands of the purchasers.
