Remember the fake photos of the daughters each rowing, to fake that they are rowers to get them into USC? Turns out, while they took the photos. Sent the photos to the ringleader, Rick Singer. HE never forwarded the photos to USC. They NEVER received a copy of the "infamous fake photos."
The Harvard lawyer on TMZ said, "Intention to commit fraud is not the same as actually committing fraud. There's no crime committed in intending." Since the photos never made it to USC, there was no crime committed.
The prosecution is saying Lori & Mossimo knowingly & underhandedly bribed USC officials. Lori & Mossimo say they thought they were only giving a donation (or something like that) to the USC college itself. And that Rick Singer was supposed to be properly arranging all that, as far as they knew. The ONLY check they wrote for the college was written out directly to USC. No person. The same way others write out checks for millions of dollars to a college to donate for a wing - which also gets their kids, who may not have the grades or whatever, to get in otherwise. That's legal.
According to Harvey Levin, their defense is appearing more and more to show that they really didn't think they were doing anything more than what other wealthy people who donate to colleges do. That they were one of the about 1300 other of Rick Singer's wealthy clients, who, out in the open, did the same thing. He wasn't operating as some back alley, shady deal. (He even tried to get a TV series made of what he did.) And if anything underhanded happened, HE was the one who did it. Without their knowledge . . and after he took their money.
