Cancelled direct buy now want resale...

I'm wondering if Disney would purposely try to block us from buying resale as we have just cancelled our direct contract with them...Actually we are still waiting on the deed paperwork to be sent to us but we are firm that we DO WANT to cancel as resale prices are much lower.

Has anyone had this happen to them?

We did tell our 'guide' that we felt 'ripped off' price wise (confusing discount figures and salesmanship bothered us). We were still interested in buying DVC but he convinced us that we would not like the restricted conditions of resale contracts. Turns out that we could always rent our points out and pay cash for cruises or ABD and we were never really going to use RCI - we really wanted to use the points at DLR or WDW.

So...I want to know before I sign those papers to cancel, is Disney going to block us automatically from buying resale because we just cancelled on a direct sale contract?

We really do want to have DVC, we just want the best possible price. (No financing needed and we don't need any points until 2015). Should we try to find a resale contract now or wait a few months and hope Disney 'forgets' we backed out?

I'm not sure they can do that. The only thing I think Disney could do would be to buy the contract themselves that someone is trying to sell you. I don't think they would even make that connection. I applaud you on your choice.

I wondered about this myself. I don't think they would purposely "block" you. We looked into buying BCV direct last year and decided to go resale the next day because they couldn't give us the Use Year we wanted or the previous years' points.

The only way it may seem like it is if you put an offer in on a contract and they ROFR it to fulfill someone else's direct sale. But that's just business.

Relax and find your resale contract. Good luck!

I think that would involve way to much coordination between the sales teams and them teams reviewing contracts for ROFR. And they aren't going to offer significantly more for a ROFR contract out of spite.

No, Disney won't try to intentionally block you but, like everyone, you always have to worry about ROFR if the price of the contract is too low.

Although they'd prefer that you buy direct, it's not in their best financial interest to keep you from buying resale.

OP, what resort were you buying into direct? If it was AKV, Disney has done little to no ROFR there as they are still actively selling and have less need for additional points. Check out the ROFR threads on the board and you will be able to get a comfort level (or not) for how safe you are.

I think it is very unlikely that Disney intentionally blocks anyone by ROFR. There would be no profit in it.

We did the presentation 5+ years ago and did not buy but bought resale a week later. I wondered like you if they would ROFR us to get us to come back and pay their higher prices but they did not.
I think (hope) you will be fine buying resale.
It is the best way to own a piece of the magic.

Just to clarify because I'm not certain what paperwork your waiting on to cancel. If you signed the purchase agreement you have 10 days to cancel and you would already have the paperwork and info in your packet on how to cancel. The timing is critical. If you haven't signed anything then just telling your guide and not signing and not returning the paperwork is enough.

As for being blocked, no. Others have done as you are doing once they discover the resale market. It doesn't meanthat a few haven't runinto the occasional rofr but they've eventually gotten contracts.

We did meet prior to that but their system was down (something about Orlando time and updates) so the paperwork wasn't available until the final night. We had lots of questions (we had first looked into DVC at a stand in WDW in 2005,but never took a tour) and told the guide of our travel plans/needs. We liked the DVC but not the price and told him so. We were not aware of resale. Guide did tell us we could rent out points if we were unable to use them but DVC doesn't help you with that. It was totally our decision to buy then and there and we were happy for about a week...

After reading many message boards we came to the decision to cancel and try to get a resale contract. We tried to contact our guide inside the 10 day period (this was in July) and we were given another contact number to cancel. Time differences meant my messages were never responded to and we had to pay the dues in Sept. After that I called again and was told to send another email to cancellations dept. I did and they called VERY early one morning to confirm that as the DVC was already 'deeded' DVC had to 'buy' it back and that would require notarized papers to be sent...That is what we are currently waiting for.

None of the DVC peeps I've spoken to have even bothered to ask why we don't want it anymore. We purchased at AKV 160 points. We are still looking to buy the same points and place. We are from Australia and only plan on using the points for DL or WDW. We would love to visit yearly (we love Sept) but every two years would be okay as we travel other places too.

So if anyone is looking to sell a AKV contract...

When we originally purchased resale (about 9 years ago), I told our guide we were doing so. She told me she had "...just come from an emergency meeting of the sales force" where they had been told that DVC would be ROFRing EVERY contract for some period of time.

Needless to say, she was lying. Our purchase went through without any problems.

The "restricted conditions" are worthless, so you'll be fine.

And you will have access to RCI exchanges anyway with a resale.

Now is the time to take a deep breath, take the time to decide if AKV is really your favorite resort looking at the resort, rooms, location, amenities, comparing all of the above to the other resorts. UY is also something that you need to decide on and remember you can buy more than one contract at the resort and combine them to make reservations.

I cancelled a direct purchase contract in July to buy resale and found out last week that my resale BWV resale contract passed rofr last week. I too worried a that I might have a problem. It would appear that it is was not an issue! Best of luck to you. I must say I feel much better about these points at the " used" price point!

But why are you so mad at them for doing their job . You don't go into a car dealer and get pissed they didn't tell you the dealer down the block has a better price . That's on you .

I am glad you got it reversed if that's what you wanted but maybe next time your spending thousands of dollars you do a bit more research .

Yes, BestDadEver I wish I did more research but hindsight is a wonderful thing! I am not mad at DVC just a little annoyed that my guide (and the cancellations team) wouldn't respond to my emails or voicemails - it's now nine weeks since my initial request. I wasn't dumb enough to believe that the sales rep would tell me about resale but I was dumb not to ask about worst case scenarios.

I'm not sure ?Disney's thinking is quite joined up enough to do that.

I waitlisted VGC points but while I was waiting the perfect resale came up I never thought it would or I wouldn't have waitlisted in the first place. I put in an offer and got through ROFR fine. Just after it passed ROFR my waitlisted points came up but I turned them down. Being wait listed did t stop us buying them resale.
