Cake Bake Shop at the BoardWalk opening in 2024

No landlords would allow their tenants to build, for free, on their property for an unspecified amount of time.
Wrong. Landlords do it all the time. I have built many retail stores for my business. We have NEVER paid rent before the store opens.

Your landlords let you sign a contract to build for free for an unlimited time? That's very generous of them.
 
I am a landlord, and I never charge rent before the business opens. No one does that I know of.
That's your choice! But do you also allow your tenants unlimited time to build their shops? Or do you give them a specific time and start charging rent/deducting from the deposit if they don't meet the deadline?
 
I can’t believe they are just filing the permit for the kitchen build. It makes me wonder if at some point in the construction there was a major issue with the existing building that had to be addressed before they could move forward. I would have thought the kitchen would have been one of the first things to be completed, not one of the last.

That is one thing Epic hasn’t had to deal with. It typically takes longer to gut and renovate an existing structure than to simply build new because there can be a lot of little surprises that can add to the time and expense.

I believe we're discussing two separate issues. You're talking about tenants not having to pay rent until shop opening, which I agree since that's based on their contracts.

I'm talking about the length of time the landlord allows the tenant to build on their land prior to opening. No landlords, in their right mind, would ever give someone unlimited time to build for free. Most likely, there's a specific deadline and the tenant would be charged if they don't finish on time.
 
I feel terrible for the owner of Cake Bake. Imagine paying lease for months and months and can't get the business going. I hope she gets to open her restaurant soon. I don't have the opportunity to visit her current shops, but I've been ordering her cakes online for special occasions. They're beautiful and delicious. 🍰
She’s a business woman. As she isn’t publicly screaming at Disney it’s quite likely for her books opening at a snails pace is financially more sound than opening for whatever reason. Better to bleed a little than a lot.

WHAT?! I’m in the commercial real estate business and the rent commencement dates are negotiated before a lease is signed, sometimes linked to build outs required to be completed by certain dates, sometimes rent is waived for X period of time after the tenant signs the lease- whatever they negotiated. But it is never “rent starts when business commences” as a landlord could go under if they get a bum tenant who wants to drag out their buildout!

That the other thing. Weren’t there rumors BWI has some structural issues with water or something during the remodel? If the landlord is causing the delays the landlord would be on the hook for restitution to the tenant as per their lease. So, it may not be the business causing the issues or getting hurt badly by them if they have a good lease!

Yes. Just verifying the build out is being handled by The Cake Shop.

While I agree there might have been some infrastructure that needed addressing by Disney I imagine that was done early ~ I'm sure Disney would want the restaurant open sooner than later, especially since it was announced. I think the build out slow down is likely all on The Cake Shop for whatever reasons.

I was wondering if maybe they thought they wouldn't have to fully rebuild the kitchen since there already was one there? Tho I don't know if they fully demo'd the inside and I don't know if the needs of the Cake Bake Shop would be fulfilled by the former kitchens. It just feels very strange that the first ever permit for a brand new kitchen was filed this far into construction. Maybe they kept getting sent back to make edits? Maybe they had to change kitchen companies, therefore new permit? I think I have empathy when it comes to building permits because it took my city 2 years to give me one to fix my driveway after a tree went over in a storm. Meanwhile, I redid my whole kitchen without a permit while waiting for the other 😂

Not never, since I am telling you I do it. I see zero benefit to making life harder for my lessees. If they can’t make money I can’t collect rent.

Fwiw. None of us know anything about the agreement Disney has in place. For all we know they are responsible for the structure and all the snails pace work they have been doing.

Doubt that. Anybody considering taking over that space would have looked at it before hand. They would have seen what needed to be done to convert it to their use.
