Auto Train Car damage anyone.?

I recently joined & tried to post Re: Damage to vehicle during Amtrak's loading or unloading by workers who sideswiped sides of my car along with close to taking off attachment of bike and carrier that appear to either been a begun theft or result of brunt force pushed off to cause major dents roof of car paint and back door scrapes & scratches. Good Samaritan as well as an Amtrak worker stopped me just as I sped off unaware....thank goodness! I took the pics of damages and prior to my ends destination station called and was given a claims number to call at my earliest..assured damages be covered. It has been 4 days since I called Amtrak's insurance speaking to"Mellissa" who cut a conversation off rather rude to state she would have to contact "Maria" who "I spoke to upon first call to station to report damage to that day (incidentally it was a man not a woman I spoke to on the phone). Oddly included at this time was Amtrak review policy of videos who intensely preview them, to which I responded great. Further into this short call that Melissa cut short I was asked if I signed a waiver to which I responded no, not that I'm aware of. If anyone has experienced damages from Auto Train transport please help us to know process you had? Any experiences in category be greatly appreciated in that I'm not sure if I need to follow up with my lawyer or assume this is Auto Train's process 😡 (an initiation of sort?), is rather degrading to customer who has had major & obvious damage.
 
When discussing this with the company, be brief and polite and do not mention getting helpers or lawyers involved.

Do not say bad things or things like I will never use your company again.

Things like I was sick that day or my shuttle bus arrived late are extraneous and should also not be mentioned.

OK, first the rule. Second, the two bolded phrases don't go together. If it was "major & obvious damage", how were you about to leave without noticing? Third, I would call back and hope to get a different CSR. During that call, I would ask when I should expect a call back. Two days after that deadline, if I haven't heard back, I would call one more time asking if I should contact my lawyer.

Taking these things together (bike attachment with dents on the roof and sides, plus the waiver question) and reading the link Kaytie gave, makes me think she might be on to something.

It appears you may have (unknowingly?) violated some of Amtrak's conditions https://www.amtrak.com/auto-train-boarding-and-vehicle-requirements which could possibly invalidate any claim.

It's possible, even likely, that nobody was trying to steal anything, but that more likely Amtrak staffers were trying to help you by removing temporary add-ons.


...“temporary luggage and bicycle racks are not. Luggage and bicycles may not be attached to the roof (unless with passenger-signed damage waiver).”

That might explain the waiver question, if, as it sounds like, you have a roof rack.
