AN ebay ? Am I liable?

This is what happened. I mostly buy but have recently started selling and I am having a oretty good run. Well I bought my dd a pair of elefanten boots for 35.00 and when they came she hated the color. So I just relisted them with a BIN for 38.00 to recoup any fees. The buyer sends me an email saying the the patent leather part was marked and the the boots are defective, her kid can't put her foot into the boot. Well I know when I shipped them they were in perfect mint condition as far as any marks, there were none. She did not purchase insurance and says the marks were probably from being bumped around in the box.? I packed them well,but as far as the defect, my dd did not even try them on? so what do I do? I really think she is just having buyers remorse. If i refund her the money, I now have a pair of scuffed up boots thru no fault of my own.

What should I do?
 
Well, it depends on what your auction said. If you sold as is, then that's that (unless you want to swallow and accept them back). You may have to eat a neg in that case. If you think she is trying to pull a fast one, and perhaps she had a pair already and wants to keep yours and send back hers, you can offer to take them back, and tell her they must arrive with the mark you put on them to identify them as yours.
If there is a chance you didn't pack them well, or there is something wrong with them (too bad your daughter hadn't tried them on, because you'll never know if there was something wrong with putting them on now), if it was me, for good customer service, in this case, I would take them back and refund the total.If you don't want to take them back, and you don't mind a neg, then you can just tell her, sorry, they were in near mint condition, I packed well, and we don't take returns. Hopefully you shipped with delivery confirmation, and to the confirmed address, so she can't do a chargeback.
 
I wouldn't give her her money back. when you purchase on Ebay, you know that there could be problems with the item you buy. Unless you specifically state that you have a return policy, I wouldn't worry about it. You might get a negative feedback but if the buyer tries going through paypal or ebay for her money back, don't worry. You will win.
 
I don't agree with this. If there is a problem with an item, it should be listed in the auction. In this case the seller's daughter had never tried to put her foot in the boots, so she has no way of knowing if there was a problem when she bought them. How would the buyer know that? If this is advertised in perfect mint condition, that is how it should arrive (assuming the seller isn't scamming). I check all of my items out before listing them, and when I buy, I expect everything to be as noted as well, unless the item says "as is".in which case I would never bid, since that could mean anything. If they were not packed good enough to stop any shuffling, and the item got damaged, IMO that is the sellers fault. In my 7 years of buying on eBay, I have on eBay..I always assume it's in the condition stated in the description.

And no, the seller doesn't always win with eBay or Paypal, if the item is not as stated. If the person paid with a charge card, or the seller didn't use delivery confirmation, they can do a charge back. And that negative could hurt, if the person puts bad packing, and faulty item.
