I'm so MAD! Help me calm down and analyze options! Please! :D

    Okay, right off the bat, I'm a "cut my nose off to spite my face" kind of person. I'd like to think it has something to do with honor, pride, and justice...

    So, we put in an offer on BLT in February that was negotiated and agreed upon through Fidelity (NEVER AGAIN!) and I was leery having read less than stellar reviews of Fidelity's service in the past but figured I'm not high maintenance, there isn't much to this process...you know...excuse making.

    We passed ROFR 3/14. We were told 2 weeks for Estoppels, then 2 weeks to close. Okay. Seems a little lengthy but fine. On 3/28 I emailed to inquire about Estoppels because I hadn't heard anything and did expect a progress update at that point to be anticipating the EMAILED or FAXED (this is important and was requested at the outset) closing documents. The Estoppel question went unanswered but I was assured that closing documents should go out anyday. Fast forward to yesterday when I emailed to say we hadn't received anything yet in the way of closing docs. Today I get a response that they were MAILED on 4/5. Well, that's great. I don't have them. The mail has already run today and I'm leaving to go out of town for a week. I really, really wanted to be closed within the parameters of our contract which is 4/20. We were fully prepared to walk if that didn't happen because there is no reason that it shouldn't be possible and since prices appear to be falling buying now might be a better deal then the deal we got 2 months ago...

    Anyway. I've cooled off some typing that out. In my fantasy, justice filled world, the seller sees this post and recognizes the situation. We contact each other somehow and decide to close through one of the other resellers thus punishing the miscreant title company for it's bad customer service. Pretty sure that ain't gonna happen...sigh...

    But perhaps this bit of justice: Seller/Buyer beware the title company that Fidelity is using stinks!

    Gonna go run a few miles and clear my head...

    That stinks! I hope for you it all works out. I would have them resend it fed ex to where you are going to be or see if a neighbor can do it for you. My contract in ROFR is through fidelity too. My credit card that I used to put the deposit on through their title company, two days later was being used in two other states. It could have been a coincidence, I will never know, but we had to go through the hassle of getting new cards etc.

    I'm confused. You passed ROFR a month ago and don't yet have the closing documents but their in the mail? Seems like a reasonable timeframe to me as resales go. Why can't they just email them to you as attachments? As for cutting out the company, that'd be unethical and likely illegal in this situation.

    I'm afraid you're not alone.

    I actually just received my closing documents in the mail yesterday. I requested that they be emailed to me about a month ago and my rep at Fidelity said they would do that. Low and behold, they were snail mailed. I received almost a week after they were mailed. Not happy about that.

    Secondly, the transmittal letter says to remit a certified check in the amount of $X to the title company. I review the settlement statement and noticed an error. Also, even without the error, the settlement statement said I owed $Y. Called them and they admitted to the error and she blamed it on the lady working for her- classy. Your name is on the letter, you signed it, so you are responsible for what is in it.

    I've heard there may be issues with this title company as others have had issues with them before. I was hoping for a more positive experience but, thus far, not so. I mean, come on. The settlement statements for these purchases have about 7 numbers on them. They're really not difficult. To screw them up as often as they seem to do by the tone of the comments on these boards is pretty poor IMO.

    We are dealing with Fidelity too. In our case it's the sellers that are dragging their feet. We sent the closing documents back 20 days ago. Our settlement date on the contract is 3/30/12. We still haven't closed yet!!! I should have been able to book a vacation on those points by now.

    Am seriously considering backing out. I agree that Fidelity has been lacking in communication. I have had to "nudge" for every bit of info and there has been precious little forthcoming. Not happy.

    Your timing doesn't seem overly slow to me. I just purchased with Fidelity and was happy with their service. I began my process in early February and closed in late March. I did get the feeling that they were very busy - must be the good word of mouth on the DIS. And Disney may have been slow with the estoppel. If you're still within the contract deadline, Fidelity has done nothing wrong.

    As to why you weren't e-mailed the final paperwork, I think it's because the final documents include a self-addressed FedEx envelope. I was e-mailed everything but the final paperwork.

    You'll lose your deposit if you cancel now. So take a deep breath...

    We started our process in late January. It is approaching mid April. We were e-mailed EVERYTHING. I get a little confused when I hear accounts of snail mail, faxes, FedEx, etc. We were given no real options and this being our 1st resale experience we didn't know any better. Communication is not good. At least we have an e-mail paper trail.

    I'm sure that the delays are the fault of the sellers in our case. It's very frustrating when someone has $9000+ of your money and there is no movement. I know people who made their offers after us and already have vacations booked on their new points. 60 days start to finish, HAH! If we continue in this fashion it looks like it will take us 90.

    I have to say that taking a breath here might be a good idea. People seem to let anxiety and frustration build when going through the resale process, but it really is a long and arduous process taking anywhere between 8-10 weeks.

    I have four contracts going with Fidelity (2 closed and 2 at ROFR) and I have to say that my experience with them has been outstanding. I'm sorry that the OP is experiencing some problems, but I think that new buyers should feel very comfortable doing business with Fidelity.

    I will agree with you that the experience with Fidelity was outstanding (I purchased and closed on three contracts last month), but I also feel the title company they use is not as quick to respond and send out documents as they could be. There may be a number of factors for this including the quantity of closings they are processing. I, too, asked for the closing documents to be emailed (this was given as an option) but they were never emailed to me.

    When I purchased a contract last year from a smaller listing agency and a different title company, things went much quicker.

    Actually, they CAN email you the closing documents (including the pre-paid FedEx slip). I used Fidelity/First American and was emailed my final docs with no problems, but I had to ask for them to be emailed.

    It seems that Fidelity uses at least two title company. For my contract they used Timeshare Title & More. I'm not very happy with them, my contract went into ROFR very fast and the communication with Rachel at Fidelity was very fast every time I asked something. Then when the contract passed to the title company it all slowed down.
    They even sent me documents to be notarized even if it was not necessary and I had to ask to correct it, a few days more of delay. It sounds weird to me that the buyer know better than the title company if a document must be notarized or not.
    However I received a few minutes ago an email telling me that the contract has been closed, and in a few days I'll be in the Disney system :cool1:
    All's well that ends well.

    Funny, I actually preferred TT and M over First American. There is a reason things get bogged down, but only the Title company knows why. It doesn't help that most of the buyers are impatient and just want their points in the system ASAP (myself included).

    I passed ROFR 3/27 (thru Fidelity), and was told that closing documents would be sent after estoppels were received from Disney, and that could take 1-2 weeks. Since I'm OOT on business next week and the following, I sent an email to Sharon Monday afternoon (going on 14 business days) asking when to expect the closing documents. She told me that she would ask title company to email them to me.

    After reading this thread last night, I sent a follow up email today asking if I would be receiving documents via both email and regular mail. She replied that I would only be receiving them thru email.

    One minute after that email, I received another that said that they had approved the closing documents today, and that I should have them by the end of the week. (did my email prompt them to find the documents and approve them to get me out of their hair??? who knows!)

    A separate note from Fidelity said that it could take 3-4 business days to receive the closing docs via email :-)confused3), and that "closing documents are emailed to you unless otherwise requested."

    Sounds like the title company doesn't quite have their processes honed to perfection (laughing, because business process improvement is my job).

    Here's to patient waiting for all of us...I just want to book my first vacation!

    This probably doesn't help easy your worries, but I just bid on a relisted contract at the same company. Turns out the seller walked away because of all the goof ups from the title company - closing docs lost in the mail, then docs were missing when it finally got there. :eek:

    I have second thoughts, but if the deal is good I'd put up with it.

    Good luck and let us know what ends up happening.

    I purchased a resale contract through Fidelity recently and had many problems with the title company they use-but not with Sharon at Fidelity. This transaction moved smoothly until it got to the title company's hands- then it was a nightmare. Everything finally got resolved and now I am a happy owner at VGC. Remember OP that is your final goal, DVC ownership! I would be hesitant to walk away from a deal that has passed ROFR. Perhaps a call to the title company may be in order. I had to make several in my case- with Sharon's knowledge- to get my deal closed. I would work with Fidelity again, but not the title company.

    This sounds familiar. We too had the closing docs mailed to us instead of sent via email. For weeks we had been communicating with Fidelity by email and then when they hand it off to the Title Company, they decide to snail-mail the closing docs? :sad2: But before you put out a bounty (notice the avatar? yes, I still have a sense of humor, warped, but humor none-the-less) on Fidelity, this is the Title Company's fault and not Fidelity. Once you pass ROFR and the Title Company gets involved, Fidelity is mostly out of the picture. They can prod the TC if you're not getting results but that's about all. I finally got in touch via the telephone with the TC after waiting for the closing docs and found out they had mailed them. I asked that they be emailed immediately and they did. I found out later that they used an incorrect address to mail them and then they used the same incorrect address when recording the deed in Orange Co, FL. Call the TC directly and ask them to email you the closing docs and be sure to check the address! Good luck.

    Sorry the OP is having such issues--and others have also. I work for the Snail Mail folks and it's amazing when anyone or a company hasn't done what they're supposed to, they blame the Post Office. I know some things go astray and take longer than expected but as a whole we deliver the mail quite effectively and quickly. Just because they said they mailed it, doesn't mean they have. And if they purchase their postage online or use a postage meter, they can take it to a post office any time after that and there is no way to tell exactly when it was actually mailed.

    OP, I dont know why you are getting all flusterred. This is normal waiting times. I have closed 4 contracts now. Just chill! Relax. It will all come in good time. Dont be so hastey to blame Fidelity. They, and you, are at the mercy of sellers. Some whom dont really want to sell but are being forced to. 1 or 2 weeks waiting will not effect your abilty to use DVC in any kind of way. Unless you are planning a trip ASAP and you are depending on this (which isnt smart anyways).

    So just wait for it all to come, and enjoy the anticipation, you will find it all that much more rewarding.
