Red face Resale Offer Question

Hi All,

We are in the midst of deciding on purchasing a resale. It will be the first DVC for us. My question is, because I don't want to offend the seller, what exactly can you negotiate on? I know I can negotiate on the price per point, but the sales rep asked me if I was agreeing to the closing cost and the annual dues in the listing. Is that something I can negotiate with a seller, like the annual dues? I know when you are purchasing a house you can ask the seller to pay closing cost or a portion of it. Is that typical when negotiating resale as well? I've never attempted an offer before so I'm unsure how it all works.

Also, IF we did purchase, I would be also purchasing DVC AP. Can you purchase for each person in your family or only those on the deed?

Pretty much everything is negotiable. On one of my contracts, I had the seller pay closing and maintenance fees. On one, I paid closing. On the last I paid both.

My advice would be to figure out what total cost you would be comfortable with and negotiate toward that number. Looking at the ROFR thread here should tell you a good range to stay in.

I would talk to the broker and ask what they think will pass. Don't worry about offending anyone, this is a business transaction and your goal is to keep money in your pocket while closing the deal.

Offending the seller should not even be a concern. This is a business transaction , nothing else. Unless you are purchasing from someone you know personally, dont even worry about sending an offending offer.
The seller wants as much as they can get, while you (should) want it for a least as possible .........within reason.
Unless its a very sought after resort or for 50 points or less, you should be offering less than the listed price, PP and negotiating on the terms as well.
At this point of the year (June) you should be asking for at least to split the dues 50/50, some brokers would call it "pro-rated".
It is a little tricky when you throw ROFR into the picture. On the contract I just purchased, the seller agreed to less $$$ per point , but no splitting anything. I came back at 1 dollar PP over the sellers offer (to pass ROFR easier) BUT we split the fees 50/50 .
Everything is negotiable in the resale game. Dont let the broker tell you any different. Some are better to work with than others and will entertain lower offers.
Be mindful of the ROFR monkey ! If you go to low, it will be a lot of time wasted and you will have to start over if Disney takes the contract you spent all that time negotiating !

Thanks for the replies. Its for Saratoga Springs, seller wants $78 a point, I'm offering 74 based on sales in the $74-76 range. Closing is $555 and maintenance fees are $1227. I was making the offer at $74 with requesting they pay maintenance fees and I pay closing.

I figured what the hay, worst they can do is say no. Saratoga has tons of listings.

SSR has recently passed ROFR for $67 - $69 and there are few contracts still waiting at around this price you can negotiate anything between I suppose.
