In fact, we forgot the no shorts rule for men and while I was talking to the Head Waiter, he explained that women CAN wear shorts and he explained that they felt that because some skirts are shorter than some shorts, that shorts are acceptable for women. This was at brunch this past summer on the Fantasy. This information was offered to me, I didn't ask. Now, I think they were referring to something like a dressy black linen pair of shorts, down to the knees, not shorts you might wear around the pool.
On our recent Panama Canal cruise, we saw them turn away several parties with ladies in dress shorts at brunch more than once. We also saw them turn away ladies in "nice" jeans. A group also showed up with sweatshirts and jeans, and they were not happy to be turned away, complaining loudly that it's their vacation and no one would tell them how to dress. The manager agreed that no one would tell them how to dress, they would just be told that they couldn't enter Palo dressed like that .

My DH likes to dress, and almost always wears a jacket and tie (and a shirt, too ) to Palo. The last few times we've had dinner there he's worn his tux, and I've gotten all dressed in my finery. We enjoy a fancy evening out while on vacation. For us, it's just part of the fun.

Men do not need a jacket for Palo dinner or brunch.

I find that so interesting when it was the Head Waiter or whatever his title is that offered up that information to us--I didn't ask about shorts--he volunteered that women could wear them because some were longer than some skirts. I wonder if there was someone in Palo at that time that had shorts on and that was his way of an explanation. I didn't check because frankly I don't care what other people wear as long as they are clean and presentable (which obviously is open to lots of interpretation).

So... When they decide to go by the dress code they publish this is the "but...last time"defense

They might let you in with capris, but if you read their dress code they could easily say no. Toss of the dice IMHO.
