I don't understand cell phones: unlocked, no contract, etc

Since it is an unlocked phone, would it work with my AT&T Sim card? It says "T-Mobile requires a data plan to use this phone." Based on that, I assume it won't work for me??

The phone will work and will give you 3G(850hz frequency). The only issue is if the phone does come unlock or not. It does say unlock but sometimes the sellers sell it that way to make more money... if your buying through ebay, im sure u have that protection...

so far, its used as a scare tactic... i see a 90% drop of unlockers sales but there is still a few out there who interpret the law to the best of their knowledge.
