The tickets are listed on the back as non-refundable and the terms and conditions one agrees to on the website also says they are non-refundable.

Are you sure it's "illegal" to resell tickets--as in, you can be fined or arrested for doing so?

I'm pretty sure what Disney is trying to avoid is scalping, not making someone with an extra ticket who can't come to a sold out party get stuck with the expense and for the ticket to go unused.

From what I could find online, it is legal in the state of California to resell tickets on the grounds of an event provided the tickets are not sold above face value. Anyone else have any more info?

The language is an out for Disney to dishonor the ticket if they think it has been brokered. That doesn't mean, however, that there is any criminality involved unless you engage in scalping.

Most states allow you to sell tickets at face value (some do let specific brokers sell them for higher amounts).

That being said, even though Disney says you can't resell them, that would be up to them to disallow the ticket being used or, if they really wanted to pursue it, file a pleading in court. But this is a contracts issue, so there is no criminality, only a civil issue.
