So very frustrated!!

So I planned a nice adult vacation for me and my hubby...we leave for WDW in 5 days...but today I went into work & got a subpoena to a jury trial that starts 10/9 ( the day we leave). I am a nurse and now have to testify for a man who is being charged with battery to law enforcement. This is a conflict of interest for me as I am married to a police officer. Am I really mandated to go? What will happen if I don't go? I am waiting for the lawyer to call me back...need some good vibes sent my way please!!

I would think that if you don't show up they will issue a warrant for your arrest.

I've always been told that if you don't go when issued a jury summons it can be contempt of court. Which means they will issue a warrant for your arrest. I would also try calling the courthouse or phone number on the jury summons. Usually they are helpful in those types of situations.

But it's not a jury summons, it's a subpoena to testify.

Jury duty can usually be postponed if you show that you had previous arrangements to be out of town.

If you mean you are waiting on the attorney who issued the subpoena to call you back, he will likely tell you "Of course you have to show up." I am assuming this is a result of where you work right? If so, you need to find out if your place of employment has an attorney who could try to negotiate a continuance or file a motion to have the subpoena quashed. You may end up having to call your own attorney for assistance.

I'd seek advice from an attorney rather than a bunch of Disney fans..

From all of the books i've read and movie's I've seen, maybe you can have the lawyer take your deposition (taped or whatever) so you don't have to be there physically?

I have an attorney client who is a huge Disney fan. It always makes me laugh a little when I receive a fax from his office and the cover sheet has Minnie Mouse on it. I also heard he always wears Disney ties even to court. Being a Disney nut I would be fine with it but I sometimes wonder what some of his clients think about it.

I did a search on the net and found several people asking the same question as yours. Many had replies from actual lawyers that said arrangements can usually be made to accommodate you.

So contact the appropriate offices and see what they can do for you.

I posted my concerns here to see if there were any Disney fans with experience in the judicial system that could steer me in the right direction. I'm also calling my police buddies to see if they have any advice. My hubby is out of town & doesn't know the latest news... Still keeping my fingers crossed!

Keep thinking good thoughts. The Courts do not want it to be a burden to do your civic duty whether it be testifying in court or jury duty, etc. In that regard, you need to gather all the information about how much your financial penalty could be as a result of any change in plans in case you need to present it. Don't forget to include the fact you have scheduled vacation time off.

What I was attempting to point out though is that the attorney issuing you the subpoena probably will not be your advocate in this matter. There are some good ones out there and hopefully you are dealing with one of those.

I really wouldn't advise anyone to rely on TV or movies for an accurate answer to a legal question.

I work for a judge and we have cases that get continued quite frequently because a witness for one side or other is not available to testify on the scheduled trial date. I don't think you would be expected to cancel travel plans with reservations. As a previous poster said, they could always take your deposition to be used at trial if you cannot be there in person.
