My question: Couldn't the gentleman look up at the ToT and see (and hear) the people in the ride vehicles falling from the top of the giant 13 story building?

I am sorry this Guest had a stroke, but he is wrong to blame it on ToT. Especially when the stroke occurred over 3 weeks after he rode it (and ignored the clearly understood written and visual warnings).

Cases like this make me want to bash my head against the wall!

First warning would have been the name of the ride 'Tower of Terror' seriously why wouldn't you take written warnings seriously with a ride named 'Tower of Terror?' Also it sounds like the cast member was doing his job by staying 'in character' for the ride. I don't know I feel bad for the guy and everything but this just sounds like someone looking to get a pay out on something and not wanting to admit that he himself made a mistake by ignoring the large amount of warnings before entering.

Like the above poster said the large amount of screamings while walking up to the ride and seeing them dropping should have been yet another warning. Seriously *head desk* moment indeed!

I may also file a law suit. According to the map description is stats; "Drop 13 stories, at random, into another dimension". I have ridden this ride numerous times and I have never actually gone into another dimension.

I don't like to pick on people when they're down, but it is not Disney's fault he suffered a stroke and they should not have to pay him. I hope that with some time, he'll come to terms with this.

Couldn't stop laughing and saying OMG while I read this! I hope they get stuck paying all the court costs and maybe they and others will learn to stop filing dumb lawsuits!

if anything, disney tends to over-warn.
the first time we rode alien encounter, we stood in this massive 2 hour line out in the hot sun (this was back when alien encounter first opened).

all through the line there were warnings about people with dizziness and back and neck etc etc etc. At the front there were huge signs with warnings. So many in fact that i finally chickened out.

Later in the day, we were on the bus chit chatting with another family.

They mentioned alien encounter, so we asked them if i would have a problem.
They laughed. Said the attraction doesn't even move. That it would be no problem.
So we went back - stood in that ridiculous line again - and did it. And loved it by the way. Bring back alien encounter!!
Anyway, that was a case of over warning. And they do that on all their rides.
So for him to say there were no warnings is ridiculous!!!

I mean seriously..it's called TOWER OF TERROR!!! Obviously it's gonna scare the crap outta ya. I seen a pregnant lady get on once before because she wanted to induce her labor and she knew this ride would do it!!

I don't think I would've done the same thing as her, but it's obvious what the ride is about. There are signs all over the place and even after you watch the video, it talks about not riding if you have these conditions and I think they announce it as you're walking to the elevators...not sure on that one

But...this is my biggest thing too: If these people would stop suing Disney over EVERY little thing just to make some quick money, these prices for this wouldn't be so high!! (I know there's other reasons that the prices are high..I'm just saying this is one of them..)

I just received a notice that on April 24, 2012, the Florida Court of Appeals upheld the dismissal of this lawsuit.
