Thoughts on Disney/ Florida Legal Battle News

If you have questions, I'll be happy to try to answer them. I drowned on too long and just had to assume listeners would know some of the background. But in case it helps, here goes. There are two (possibly three) agreements at issue. One is a "restrictive covenant" which RCID and WDW agreed...

Thoughts on Disney/ Florida Legal Battle News

Yes. Most federal court civil litigation takes years, not months. Criminal trials take priority due to the Sixth Amendment.

Thoughts on Disney/ Florida Legal Battle News

Sorry, I had paying work that had to get done today. :duck: If you want to read the Florida Supreme Court decision, here is a link to an unofficial but normally reliable reprint of it https://law.justia.com/cases/florida/supreme-court/1968/37569-0.html You can see the state challenged RCID's...

Thoughts on Disney/ Florida Legal Battle News

Thank you all. It is always a privilege to be on the podcast. I have to tell a story. When I research legal issues, I make notes of statements in decisions and statutes, typically by cutting an pasting from the online version of the decisions. These notes are not well-organized or much of a...

    Delted Show? "Roundtable 10/3/06"

There is definitely something wrong with the link in the xml feed. The other links from this period work so I guess the mp3 file has been moved. I uh, ahem, have a copy of the mp3 saved in my iTunes folder. If your email can handle a 13 megabyte attachment, DM me an email address and I will...

Crohns and DAS = denied. MODERATOR NOTE: No diagnosis is automatically allowed or denied for DAS. DAS is issued based on needs, not diagnosis

I agree with you. Plus, I have already addressed the assertions repeated here (see post 39 and 42) and I have been ignored so I don't really feel a need to repeat myself. And if there isn't a Disboards rule against discussing Chevron deference, there should be. . . . :-)

Crohns and DAS = denied. MODERATOR NOTE: No diagnosis is automatically allowed or denied for DAS. DAS is issued based on needs, not diagnosis

If you have a copy of the October 19 decision you mentioned, I'd like to see it. I'm not aware of Disney ever aguing that it does not have to offer DAS or any similar program. Now, I checked my records of Disney litigation and noticed that October 19, 2022 was the day that a number of families...

New Class Action Lawsuit Challenges WDW Reservation Requirement for Platinum Passholders

I probably should also have made the point that the court dismissed the "shotgun" complaint on its own, without Disney moving to dismiss it.

New Class Action Lawsuit Challenges WDW Reservation Requirement for Platinum Passholders

No court has ever accused me of being concise. They sometimes find me coherent, but that is always relative.

New Class Action Lawsuit Challenges WDW Reservation Requirement for Platinum Passholders

Shortly before Christmas, there was an interesting development in this case, at least for civil procedure nerds like me. After making the plaintiffs proceed under their real names, instead of a pseudonym, the judge then dismissed the complaint without prejudice. The judge found the complaint...

Disney wins First DAS ADA Discrimination Lawsuit

It depends on how you define settlement. Disney winning at trial and on appeal and then agreeing not to pursue costs if plaintiffs don't pursue to the case further isn't what most folks think of as a settlement. Disney isn't actually giving up $23k in real money. In reality, most folks don't...

New Class Action Lawsuit Challenges WDW Reservation Requirement for Platinum Passholders

It seems to me that the concerns about the lawsuit's impact on current AP ticket sales might be misfocused, at least if Disney acts rationally. If as alleged WDW sold "no blackout" AP's in 2019 and 2020 and if instituting a reservation system breached that implied contract, the focus is on that...
