I am currently a Feb use year DVC owner at BLT. I just purchased 100 points at VGF also w a Feb use year. I was told by my guide that NO ONE was getting 2013 points avail for use as the resort doesn't open til November. My friend also owns at BLT, purchased at VGF as well and has an April use year. She got 2013 points!!! And will be getting 2014 points as well when it's time obviously. I called and questioned my guide as to why she got points and we didn't when he told me "NO ONE" was. He says he told me FEB use year wasn't, April was. Totally not true! Feeling hosed because I put a 20% down payment and am making 7 months worth of payments before I get any points, but meanwhile because her use year is different she has points now, can bank them and gets them again in April. Why am I paying for something for more that half a year that I can't utilize unless I borrow from next year! Seems unfair. My guide old me that they can't give them to everyone bc then "too many points will be floating around for people to use". Feeling frustrated bc it's not what he told me originally... I was almost afraid to post this bc I've seen how some folks get blasted on here, but I'm putting it out there bc I'm wondering if anyone else on here feels the same way.

Ugh I wish I would have reached out to you all before I did this! I'm so mad that I didn't get a full explanation. Foolish that I didn't ask more questions but I'm fairly new to this. I always trust Disney, and that I'm getting the full story. My guide had the audacity to tell me that's garment will call me tomorrow and maybe they can send my family and I for "a real nice dinner" next time we are at WDW!!!!!! Mad!!!!!!!
So first off, I'm sorry that you're frustrated by this situation. There are a couple of things at work here, some of which are equally applied to all new owners and some that specifically apply to your situation. What others have said is true, anyone who bought a Feb or Mar UY at VGF did not receive 2013 points. You needed to buy Apr or later. That applies to everyone. What applies specifically to you is the fact that your guide was some combination of secretive and/or dishonest. Like Bill said, Disney has this frustrating policy of only answering the question you ask. So even though they know there are cost saving options available to you, unless you specifically ask about them, they won't offer. I think in this case you would have had to say "what UY do I need to buy in order to get 2013 points?" In that case, your salesperson would be forced to answer, because it's a question of fact that can't be manipulated.
That being said, one thing that I haven't seen addressed here is the fact that you bought during the promo phase for existing owners. During that time, owners were only allowed to buy contracts with a UY that matched one they currently owned. So buying at $145 AND getting current points was never an option for you. Your choices were to buy at $145 and get no 2013 points or buy at $150 and get current points. Yes, it stinks, but it stinks for all Feb and Mar owners equally.
Going back to your specific issue, DVD technically did nothing wrong with the structure of your contract. You will still get everything you're entitled to, regardless of the fact that it's not ideal. The real problem is that you feel you were done a disservice by your guide. This is a whole other issue and what you will receive depends on how far you are willing to take it. You can start talking about going to the Florida Real Estate Board, contacting your attorney, etc. The uglier you are willing to get, the better the potential outcome for you. But do you really want to go that way? I would suggest seriously considering taking them up on that free dinner offer, chalking it up to experience and, of course, requesting a new salesperson from now on. Good luck.
ETA: It wouldn't hurt to ask for developer points, as others have suggested. Just two things about this. First, make sure you are clear that you are requesting them to compensate you for the fact that you feel that your guide misled you and NOT because you simply didn't get any 2013 points. Second, be prepared for them to say no, and decide in advance what you will accept as a resolution to this situation. Again, good luck. Please let us know how it goes.
