sad day....seller won't close

I use a lot of my DVC points for the Disney Cruise. My understanding is that I cannot use points I may purchase through re-sale for booking cruises. For this reason alone I stay away from re-sale purchases.
That being said, I completely disagree and do not think Disney Vacation Club should be able to place these restrictions on owners. They already have their money and on top of that, they are willable and transferable but not saleable.....grrrr

I agree with you about the current restrictions on resales. But I wouldn't rule out resales for that alone if you also want to stay at WDW. You could pay for a lot of cruises for the difference in price between direct and resale. Just sayin'.
 
For those who are interested we are moving forward with another contract, hopefully being sent in for ROFR today!

200 '12 pts, 197 '13 pts, and all going forward
Crossing our fingers this one works out!

Ok, have to ask why Vero?

Please know that if you doing this thinking you can easily use Vero to book WDW, that is not always going to be the case and while contracts to buy Vero are less expensive, the dues are very high. You are going to pay those dues for a long time.

I would buy at SSR over Vero, unless you are buying Vero because that is where you will stay the most and you want 11 month booking to get a Beach Cottage.

sorry... this just happened to me too last week.

I had a beach club I offered the asking price, and the selller declined my offer and then raised the price $5.

Seems like this maybe more common than we knew of?

I had the same two weeks back. Offered full price and the seller came back with a counteroffer that was $10 higher. I mean, if you wanted that much ask for it up front! Don't waste everyone's time.
 
in traditional exchanges the advertised price is considered the offer, and if you agree to that it's considered 'acceptance'. Which paired with your payment is a contract. I get the feeling that the resale brokers are not that up on real estate/contract law if they are allowing this stuff to go on. That said, even if they went with it, the seller could breach by not returning docs on time or something, so I guess it is better for them to just let them change i up front. While we were making offers at least one of the brokers was basically acting as an auctioneer. It's fun in this market perhaps but we weren't interested in playing the games. We just found different contracts.

I guess my basic point is I think people should have to sell for their advertised price, but I recognize that practically people have opportunities to 'get out of it' later. That's why I think maybe sellers should have to escrow some money, just to make them feel like they have skin in the game. They might think twice before just deciding not to sell at the 11th hr. In traditional real estate, the contracts are serious stuff.

Do you think the brokers are encouraging it?
 
I absolutely think at least one that I dealt with was. If I didn't remember that this was a high-end luxury purchase and likely most of the resale buyers are fairly savvy I would annoyed enough to look into the applicable FL law--but I know in my state if a realtor acted like that, even or especially a dual agent, they would likely get in trouble with governing ethics groups. For example, you can almost always get the DVC brokers to tell you about any other offers and the amount. As a buyer, that can work out in my favor, but I know that a realtor is expected to hold offers confidentially.

Again, it's not something I am too bent out of shape about, because we were the first offer I assume on the contract we are buying and they accepted that day, but some of the other deals we were working on we felt the brokers were actually trying to drive up the price.

I know at least one broker has refused lower priced resales in the past supposedly because they didn't want to drive their prices down.

Seemed shady so I didn't bother looking at this broker's listings going forward.

That's funny because I called to make a offer and the broker told me someone else already made an offer and had to wait until the seller declined the original offer before they presented mine.
 
It was a couple of months ago, but I made an offer $10 lower than asking and we settled for $5 lower...for 150 points at VWL. I was happy, happy, happy...and it came with 50 banked points....:love:

So I think under one broker it may have been pending..

At any rate, I have moved on, and am goign thru ROFR process again.

I'm pretty sure some brokers don't use exclusive contracts with sellers, so sellers can list with more than one broker.
 
But if you offer has been met and you're under contract, should then the seller have to take it off the market at the other brokers.

And not leave it open hoping to get a better offer?
