Still waiting to close

So I am here really just to vent, but it does go to show you that the time frame is really dictated buy the buyer/seller as much as the companies you are dealing with.

We received our closing documents on 6/13/13 and reutned it with our payment on 6/15/13. First American still has not received the closing docs from the sellers yet. They are sitting on our money and waiting. I called First American on Tuesday and got a "Oh I'll give them a call and get back to you when I hear more" and have not heard back anything yet but will call again starting at 9:15 am

Ok rant done (but I still don't feel any better) lol

I feel your pain. We took 5 weeks to close because the sellers took ages to return paperwork. We did a bank transfer for the funds where they are received by the broker the same day. Next time I am not going to wire money until the sellers docs have been received.

I was thinking the same thing, They are sitting on my money that I could be using for other things while waiting
 
I would contact your agent and ask them to give the seller a call. I was told the same thing last month by First American when I was waiting to close. I called Sharon at Fidelity, and she contacted the sellers.
Turns out, First American had sent the sellers closing documents to the wrong e-mail address. Once the seller received their documents, they returned them the following day.

Hope you close soon.

I did call Shawn at Fidelity yesterday, you would figure if you had to sell or wanted to sell you DVC membership that you would want your money I know I would.

I would contact your agent and ask them to give the seller a call. I was told the same thing last month by First American when I was waiting to close. I called Sharon at Fidelity, and she contacted the sellers.

Brokers and title companies are just pushing paper, just another day at the office.

Owners who are selling sometimes feel depressed and are slow to respond because they are giving something up, we want to keep things even when we can't afford it or don't use it.

Buyers want to make a reservation as soon as possible and often don't understand why the other parties in the transaction seem to have a ho hum attitude and seem to move in slow motion.

We are on the exact same timeline as you and our sellers told Sharon they returned them but then didn't. Now one of them is on vacation........I hate people.
 


Sent money in on May 4th with a closing by EOM. June 12th, the Sellers sent in documents.. but missing signatures. Still the docs aren't in. I lost 3 months on a previous seller back in January and now this. So, I've had extremely bad luck with sellers responding after accepting offers. If they didn't want to sell, then they should just say so. I have ~$30K tied up on good faith for an OKW extended to 2057.
 
argh-- i really wish the brokers would figure out a way to penalize sellers not acting in good faith.
 
Sorry to everyone who is still waiting...
We just sold a contract. The contract was submitted to Disney ROFR on May 20th. I was a little nervous because I was going to be out of town (14-22 Jun), but since Disney has been taking 30 days on ROFR I figured I would be back by the time the closing docs were prepared....But,
The contract passed ROFR on 17 Jun. :thumbsup2
And, the closing company got the documents ready by 19 Jun! ::yes::
So, I called both the closing company and broker to let them know that I couldn't act on the closing docs until I returned home....
So, on Jun 24th DH and I got everything duly signed and notarized and sent them off using next day mail.... The closing company let me know when they received the docs the next day. But, they were still waiting for the buyers docs before they could set a closing date. :confused3
I just received an email from the broker that we closed on Jul 2nd. I wonder if we actually closed a day or so earlier because the info showed up on the OCC web site on Jul 2nd (it wasn't there on Jul 1st when I checked).
So, the next thing I will be checking is whether or not I can see the points online. As soon as they disappear, I will know Disney has loaded the points on to the buyer's account. :cheer2:

I talked to Fidelity last week and they got ahold of the seller. They said they sould sign the paperwork and send it Monday (july 1st) They received the closing documents on June 12th and we sent the check on the 14th. ARGGGG:(

Will check with American title today to see if they received the paperwork or not. I will say that Fidelity has been very responsive, AMERICAN TITLE ? NOT SO MUCH

It is a good idea to check in with the closing company. (I believe at this point, I would be calling daily for an update.) It is also possible you have closed and they just didn't tell you. You can check on the OCC web site to see if your documents have been recorded, too. Here is a link: Orange County Comptroller web site
On the contract that I signed, it said that closing had to occur by July 11th (or within 30 days from when the estoppel information was provided by Disney to the closing company) unless extended by other provisions of the contract. Does your contract have a closing by date? Perhaps if you reminded the closing company that this date is coming up, they might have more incentive to do something to move this process along.

I have to say that I am surprised with our experience with american title after hearing what others have said. We got our paperwork to sign a week after rofr which was fine, but I had a couple questions regarding the paperwork. Cammy has been great and very responsive. She has gotten back to me within a few hours at most. So maybe it's certain people that are hard to get ahold of?
 
I echo your comments Moniqu17. I too also had Cammy and I found her to be extremely helpful and responsive to communication.

Thats who was my closing agent but I found the oppisite. Would say I'll call you back and not her from her, etc. Everybody has different experiences, now that Ihave finally closed it is all behind so it does not matter. I will say that the delay in closing was not her fault for Fidelity's fault it was a slow seller returning the paper work. I don't want to give false impressions. Fidelity was great a little over a week ago when I called them, they called the seller to see if there was a problem that was keeping them from returning the paperwork and then emailed me with an update. Cammy told me she was goign to do that a couple of days prior and I never heard back from her.

Again not a disaster just a inconvience

I just wanted to share my experience. We decided to sell our DVC. Scheduled to close next Monday but we are delayed because the buyer has not returned the paperwork. I would love to get my money. Just shows the fault is not always the seller. When I contacted to closing agency to see what was up they emailed the buyers if I did not call I wonder what would have happened
