stopped by a DVC kiosk while at disney. was discussing several things when resale came up. the cm said that you cannot use resale points for some dvc resorts. i never heard this and seriously doubted it. is this true. i know there are restrictions on resales but not at the dvc resorts. he did seem more like a used car salesman. very unusual for them to start sounding like that. i just attributed this to his personality.

That salesperson is absolutely wrong. You can currently use resale DVC points at ANY DVC resort.
 
There have been rumors they be changing to not allowing resale points used outside of home resorts, but it's not the case currently.

Incorrect. You might have been talking to an ASA who needs more training or someone telling a lie to make a referral.

As time goes on DVD seems to be changing their colors and are acting more like other timeshare companies. Hopefully their new management will get a handle on things and do it Disney style.

Perhaps he meant DISNEY resorts? (Disney Collection Resorts)

The Disney Collection isn't available to owners using resale points - It seems as though this is what he likely meant... but just didn't say it correctly.

I wouldn't jump to many conclusions... but it is encouragement to know your own memberships inside and out.... 100%.

We always assume that a Disney/DVC employee/CM will know what the "truth" is in a situation, but in fact.... they don't.

We have to know what is going on to be sure we get everything out of our membership that we can!

I can make up lots of rationalizations, but I think you nailed it -- he lied.

The bright side is that -- currently -- clowns like that don't last long with DVC. Hopefully that won't change.

Probably a refugee from some sleezy timeshare sales organization, and most likely one who didn't make it there either.

An I'd bet that's all you'll hear is rumors since I do not believe this is legally possible for the current resorts in the club or any future resorts added to the current club. There is no wording in the POS that would allow that option to be implemented.
 


why would that clause has to been included ahead of time
in the pos ?

especially from the first resort ...to the last?

The legalities (POS & timeshare law) would have to give the right to justify such a change and IMO, it does not. The TOWL is no a contractual issue. All contractual changes have to be justifiable within the legal constraints in place. I believe the ONLY way they could make this change would be to have a vote of the membership itself per POS rule and I believe even then it'd require a 60% super majority IIRC. As I've said before they might be able to slide into it with a VIP system that would affect both qualified and non qualified points.

This is the same method that the DVC falls into when generating the POS, what they include has to be allowable under statute language, esp 721. That's why you get the wording about not buying expecting to resell or rent for profit, it's required by FL statute.
 
I have a feeling that the DVC rep either misspoke or was misheard. I would not jump to the conclusion that he lied. I just got off a cruise and it seems that the current tact that DVC sales uses when someone mentions resale is to discuss those things a resale buyer does not get. The main one being losing access to the Disney Collection, Disney Hotels around the world. They then go on to explain that you are paying the same dues as a non-resale owner but get less vacation options. All of which is true. You have to weigh the lost options versus whether you will actually use any of them or if they are of value to you.

I do agree with the person that said that if you are going to buy a product as expensive as DVC that you go in with your eyes open and do not trust sales people for all your information. A sales person represents the seller not the buyer. Do not expect them to mention or dwell on the negatives.

It's been awhile since I've read my contract in detail but isn't there something about no guarantee of additional resorts being added? Would that allow new resorts to only be added to direct purchases?

No, what they could do would be to create a new system not directly related and change the legal structure going in. They could even give access to some current members along the lines of this discussion. However, once a resort is added, that resort becomes part of the current club under the same rules. Of course only the declared portion is truly the "new resort" addition.

There are statements about not expecting new resorts to be added to the club, it's standard issue in case something happens. We've already seen 2 resorts announced but never built plus several in the planning and purchase stages that never happened.

If it's in the club you'd have access. IMO they do need a Maui option in a GOOD location to bolster that segment.

No putting lipstick on this pig -- that is simply NOT true.
So if DVC decides to build a resort on Maui, you wouldn't be able to use it there.
