Per Beth Karas, what to expect with closing arguments and deliberations

Wednesday, April 24, per Judge Stephens:
- Wednesday May 1st, 9:00 AM Jodi time (noon, EST), staying until they finish (could go well after 5 PM).
- Thursday, May 2nd, 9:30 AM
...final Jury instructions will be read.
- Thursday and Friday, May 2nd and 3rd, Closing arguments.
- Then the case will be submitted to the jury for decision.

If guilty of 1st degree murder

  • we go into an aggravation phase (was the death caused in a cruel manner, did she know Travis would suffer)...the jury will deliberate a second time.
  • jury decides life or death. If they find it was not cruel, they'd vote not guilty and the sentence would be life.
  • if life, judge sets sentencing for 30 - 60 days; JUDGE will decide if she'll ever be eligible for parole...either LWOP or life and eligible for parole in about 25 years.
  • if death (Jodi knew Travis would suffer), then we go into the sentencing phase...the DT would ask for leniency, the jury would deliberate a third time, then she will be sentenced immediately to death (sentenced immediately, not executed immediately). The jury COULD deadlock at this phase, there'd be a mistrial for that phase and there'd be a new jury for that phase only.
If guilty of 2nd degree murder

  • the judge sentences her, to no less than 10 and no more than 22 years. JA would get credit for time served...4 1/2+ years. If the judge sentences on the lighter end, she could be out when she's 40.

Per Jingasaurus on HLN:
"I think even manslaughter may go to the jury. It's never used here I understand but there is a heat of passion manslaughter. So I think one question is will the defense ask for that and will the judge give that."

September 2006 Travis Alexander met Jodi Arias at a conference in Las Vegas. At the time, Alexander was a 30-year-old motivational speaker and legal-insurance salesman. Arias, then 28, was living in Yreka, Calif., and was trying to make it as a saleswoman and an independent photographer.
Jodi wasn't living in Yreka when she met Travis, she was living with Darryl Brewer in Palm Desert, CA, in the house she and Darryl bought together. Darryl testified to this earlier in the trial."

Later Tuesday, Martinez began calling rebuttal witnesses starting with a state-hired clinical psychologist who evaluated Arias, as the prosecutor works to discredit two key defense witnesses -- one who diagnosed Arias with post-traumatic stress disorder and amnesia and another who said the defendant suffers from battered woman's syndrome.

Martinez accused both defense witnesses of shoddy work, and of basing their opinions on biased findings after forming relationships with Arias.

Arizona clinical psychologist Janeen DeMarte first addressed the more than 40 hours the defense's domestic violence witness -- psychotherapist Alyce LaViolette -- spent interviewing Arias in jail, explaining that amount of time was extreme to come to a definitive diagnosis.

"It becomes therapeutic," DeMarte explained, adding that such a relationship could skew findings. She said that amount of time would only be needed for those "who weren't very good" at their jobs.

Martinez then worked to the attack the credibility of another key defense witness, psychologist Richard Samuels, who diagnosed Arias with amnesia and PTSD.

DeMarte explained how Arias' responses to certain questions on tests administered by Samuels to reach his diagnoses were untruthful, meaning the conclusions by Samuels would be invalid.

DeMarte later said it was merely "other evidence that Ms. Arias decided to lie..."

She was immediately cut off by a defense objection, which the judge sustained and questioning moved in a different direction.
