Legal disclosures on vacation club purchase -- sweepstakes section

The DVC game sweepstakes (where you can win points for 3 years) has a few legal links. One at the bottom is (EDIT) "important disclosures" (end edit) and seems to be more geared for someone who may purchase DVC. The wording isn't geared toward the sweepstakes winner. It's interesting that only two resorts are mentioned with regard to amenities possibly not being available to members in the future. (The sweepstakes winner gets points at the animal kingdom). Here is what it says:

DISCLOSURES


  • Membership requires purchasing a real estate interest in a
    Disney Vacation Club Resort. Not an offer where registration or other legal requirements for timeshare solicitation have not been met. Real estate interests must be purchased directly from Disney Vacation Development, Inc. in order to have access to the Disney and Concierge Collections. Vacation destinations offered through exchange opportunities require a fee and may be modified or withdrawn at any time. All accommodations are subject to availability. Park admission is not part of Membership.

  • Aulani Phase 3 and certain amenities under construction; scheduled completion 2013. Purchasers should not rely on the continued existence of, and access to, certain amenities at Aulani, a Disney Resort & Spa, Ko Olina, Hawai`i such as Laniwai, a Disney Spa; Aunty's Beach House; restaurants; and recreational facilities that are not part of Membership. Certain offerings require a fee.

  • Purchasers should not rely on the continued existence of, and access to, existing Disney's Animal Kingdom Lodge amenities, such as savannas, restaurants, and recreational facilities that are not part of Membership.

  • The Top of the World Lounge and observation area at Bay Lake Tower at Disney's Contemporary Resort are not part of the timeshare plan. Limited access is based upon availability and may be terminated without notice.

none of this seems odd to me.

werent AKL rooms added initially so they could meet the percentage of resort built to legally start the sell of timeshares at AKV? maybe they are thinking they may eventually pull the ability to stay at AKL. also, TOWL is not part of the timeshare so if it doesnt make money, they may turn it into something else thay does.
 
That resort disclaimer has always existed for DVC resorts for which portions have not yet been completed and declared into inventory to be sold, currently Aulani.

TOWL has never been part of the timeshare and thta was made clear when BLT first went on sale, and Disney could at any time decide to open it to everyone, close it off to everyone,or turn it into something else.

Actually similar disclaimers as AKV and Aulani relating to restaurants and other amenities exist for all the resorts since Disney could shut them down or change them. The other resorts are not part of the publication because they are not the ones being promoted for sale now.

They can't do that unless they buy back all the deeds from people like me who own a part of a Unit within Jambo House! The wording here is similar to what is in the paperwork we signed when we bought AKV, namely that any of the amenities at the resort (animals, restaurants, etc.) is subject to change. The paperwork specifically states that the animals could be removed from the resort at some point in the future.
 


I'm surprised they did not include GF in the under construction disclosure.

TOTWL was not included originally, then Disney added it to the timeshare so BLT owners can pay for the running and upkeep of the facility. The lounge is run by Disney and all sales profits go back to Disney. Currently Disney pays a fee to the owners to use the lounge. If Disney decides to close the lounge, it will become another "Attic" which is at BWV.

Since GF is not for sale yet probably doesn't apply.

Typically they include any resort that has been announced but not yet available for sale. It just says that there's no guarantee it will become part of DVC. Others have posted recently that it's in their contract. It has come into play a couple times - Newport Beach, Eagle Pines.
 
Yes, I'm pretty certain Aulani was mentioned in some paperwork we had along the way and was after the announcement but prior to it starting sales.
