Double checking some things a guide said

I'm a member (own at Animal Kingdom) and my parents have been talking about buying an add on contract, under my name, so I didn't have to continually use my points for rooms for them.

They spoke w/ a DVC guide yesterday in WDW and got told some things that don't seem to make sense to me.

1) If they/I were to buy re-sale, the points would only be able to be used at that resort. No 7 month window at other resorts. Buy say OKW resale- you only can only use them at OKW.

2) Tied into story #1, If they/I were to get say 60 points at OKW those 60 could never be used in conjunction w/ my 230pts from AKL. Even if staying at OKW.

After the whole presentation and being given tour of the property at OKW my parents decided to buy points- under my name and contract- at OKW.

Now- the guide told them that there is currently no inventory for OKW with an October use year. SO, he took a deposit to hold the price point and told them they were on a wait list for the points. But it should be no problem, they'll have 2011 points as well as 2012 shortly.

Really nice thing was a $100 gift card for taking the tour- rest of it seems odd to me.

Just spoke to mom and dad- Guide also told them that resale points can't be used for RCI exchanges or cruise line stays- which they don't want to do anyway- but still...

Not quite the right info. Something got lost in the translation.

Resale or not, you can use your points at other DVC resorts within the 7-month window. And you can book your home resort at the 11-month window.

The only resale restriction now is for use of your points outside the DVC resorts.

Thank you for the response-

I was able to find that there are resale restrictions now in place- however they are not as drastic as my parents understood

Members who purchase from anyone other than Disney Vacation Development, Inc., on or after March 21, 2011, will not be eligible to use those Vacation Points to make reservations within the Concierge Collection, the Disney Collection or the Adventurer Collection. Those Vacation Points will instead be valid only for reservations at Disney Vacation Club resorts, as well as for RCI® exchanges, Club Cordial and Club Intrawest.

The affected collections are special Member benefits programs offered by Disney Vacation Development, Inc., and are not part of Members' Ownership Interests. That said, Members who purchased on the secondary market prior to March 21, 2011, may use those Vacation Points for all Member Getaways.

Note that the policy doesn't impact banking, borrowing or transferring Vacation Points. All Members will continue to have the ability make such transactions, regardless of where they purchased their Ownership Interests.

Can anyone tell me if my direct purchase contacts can be co-mingled w/ a resale contract?

Thank you for the response-

Yes, at 11 month window for same resort, or 7 month window at different resorts. ... assuming same use year.

When you make a reservation for something that doesn't allow resale points, DVC will know which points are resale and which are direct sale. But using DVC points for any of those things that have the current resale restriction aren't really the best use of points anyway.

You may want to talk to that guide one more time to see what they really said. If they did say what you are saying they said, then they need to be reported to DVC for lying to a potential customer. That's just wrong.

In the mean time, you might have them check the resales and they can purchase their own contract of any amount of points and cancel that direct purchase.

This whole transaction seems screwed up to me.

If Mom and Dad are putting the purchase in your name, I would have them cancel the existing direct purchase and gift you the money for you to buy a resale contract.

Buy the same UY at any resort you want and make sure that you title it the same as your original so you will only have one membership.

Somebody else had a thread reporting similar things to what your Mom & Dad were told. Either same guide or more are getting desperate enough to lie to make the sales.

It sounds like they gave the info related to them buying or buying a contact that was titled differently. In that case it cannot be combined with what you have directly. Otherwise they simply lied to them and I'd cancel and get their money back now then look at resale. I would not work with this guide again no matter what though I doubt he's with DVC very long.

They spoke w/ a DVC guide
Suggestion #1 -- lose this silly term. They spoke to a timeshare salesman. They're not "guides," they're not your friend...they're timeshare salesmen.

Dean is a friend, and I value his experience and advice. But I'm not as nice a person as Dean.

IF, in fact, they were making the purchase in your name and into your contract, items 1 and 2 above are bold-faced lies.
Guide also told them that resale points can't be used for RCI exchanges
That's a flat-out lie and the "guide" knows it's a lie.

Take the money and run.

And then, RESCIND. They were sold a pack of lies. They have 10 days to rescind and get their deposit back, no questions asked -- that's Florida LAW, not Disney policy. RESCIND and start over.

That's essentially what's happening. They're doing the legwork and when they find something that works I'll be signing all the paperwork and making the purchase with the large stores of unmarked bills I keep under my mattress.

I wasn't in Florida w/ them when they spoke to the guide so dad put down the deposit and they'll call me when/if it comes through.

It does seem kinda convoluted- but it should work out.

Direct and to the point- appreciate it Jim

Thank you to all for the responses.

In this case they should have even longer than the 10 days as they simply have a deposit and not a contract but I wouldn't chance it and I'd cancel now.

If you want them on the contract, add them now to yours then you can later title the new points the same. For WDW resorts you can do this easily on your own for around $50 or less.

I hope they will get their deposit back and you can then look at resale. You can find OKW, Oct UY contracts. They are not small 60 point contracts at this moment, but the price paid for resale compared to direct could make a huge difference. As you stated in a previous post, there are some restrictions with resale, but for a lot of us those restrictions are no big deal.

One other thing to keep in mind about OKW, some contracts are extended and some aren't. You'll need an extended contract to expire at the same time your AKV points expire (if that matters to you at all).
