DVC - Non-Albertan & Ontario residents

Any DVC'ers from provinces other than Alberta and Ontario on here?

We are joining DVC and will need to use an address in Alberta to join.

My husband thinks we should be able to change our address to our BC address once we become members. He say's people move all the time and believes DVC should be able to change it to our BC address once we are officially members.

When I was talking with the DVC rep, he suggested we couldn't.

Anyone with experience with this?

I always suggest that people be very careful when using misrepresentation when entering into legally binding contracts.

I was led to believe that non-Albertan and Ontario residents can "legally" purchase DVC memberships.

To actually sign the paperwork, etc. I would need to go to a notary in the states or go to Disney so it is legal. Which we will do.

Does anyone know more about the legalities of DVC ownership for non-Albertan or Ontario resident?

You might consider sleuthing through the DVC Canadian Members sticky at the top of this forum http://www.disboards.com/showthread.php?t=1398569 There are plenty of DIS/DVC members there who are not in ON or AB. Start at the end with the more recent posts. If you find someone you think may know, send them a PM asking how they did it. That might draw their attention to your plight, and they would be able to explain how they have arranged their ownsership.

We own at OKW. We purchased our contract on the resale market. When we bought in, Disney had just registered in Ontario to do direct sales of timeshares. We could not speak to a guide on the phone from Winnipeg and had no choice except resale.

In brief, there are provinces that regulate the direct sales of timeshares. For Disney to deal with that person while they are in their home province, Disney would have to register there (as they have in Ontario and Alberta).

If you are physically present in Florida or California, Disney can deal with you directly and you can purchase from them direct regardless of where you live.

Since this is a purchase of a right to use real estate for which you get a recorded deed, you do not want to have any misrepresentations about your residence either to Disney or on the deed. That could void the sale as being fraudulent.

The simple advice is to do what the rest of us have and either buy resale or buy from Disney when you are actually down in Florida or California.

If you purchase resale, it doesn't matter where you live (so you can use your real address, and deal with the reseller from your home).

You may want to seriously consider a resale purchase if you haven't already.

Thank you so much for your info.

We have looked at resale and have decided to go for direct as it gives us no restrictions at this point.

We definately want our membership to be legally binding. From my last conversation with the rep, it sounds like I might just be able to use a notary in the states (only a short ferry ride away for me) to legally do up the paperwork, or I might just book a flight and go down to GVC and do it in person.

I appreciate the time eveyone has taken to answer my questions.

OP we ar BCers, we bought as BCers... you can buy resale from BC OR you can buy in person at a DVC sales centre.

Honestly it's ridiculous that you'd consider a fake address for yourselves.

The only advantage of living in Ont/AB for DVC membership is you can talk to your DVC guide (salesperson) from your home.

Anyone, regardless of residence, can buy into DVC. However, Canadian residents outside of Ont/AB need to be in FL/California to sign the paperwork.

Your DVC guide cannot candone giving a false address -- he/she would be knowingly engaged in fraud.

Just to be clear we are not giving a "false address" to purchase a DVC membership. I was led to believe I could receive an information package on how to join DVC via an address in Alberta.

People on disboards are looking for knowledge and support from other Disney lovers - they are not looking to be insulted or ridiculed. Please keep this in mind when you post.

In addition to purchasing in Florida or California, you can also purchase onboard a Disney ship and they have good incentives to do so. Once the Aulani paper work fiasco is straightend out, you'll be able to purchase there as well.

Certainly, the quickest option for you is to do as you suggested, take a ferry ride into the US and visit a notary ... but it's not as fun as a Disney Cruise :woohoo:

It is very difficult to get information on DVC when you live in BC. The Disney rep does not give much out. I get that it is for my "protection" as they have not filed a paperwork to work in BC, but I have gotten a lot of incorrect, misleading, and conflicting information from various sources. I'm just trying to sort it out and I'm getting a little mixed up in the process.

It's pretty easy to get a bit confused when dealing with people over the phone or here on the internet. I'm guessing that many reps don't even want to deal with someone they can't sell to immediately.

As I understand it, these are your options for purchasing DVC as a resident of BC:

1 - Resale: I know you've mentioned you don't to, but it's a cheaper option if you're willing to live with the few restrictions Disney's put on them.

2 - Direct at Disneyland, Walt Disney World, Aulani (eventually), or onboard a Disney Cruise

3 - Arrange the purchase to be completed at a notaries office in the US

4 - Move here to Alberta where jobs are aplenty and there's no snow (yet) :rotfl2:

We purchase a DVC membership almost 10 years ago. We were living in Ontario. 5 years later we moved to the Maritimes and we are still members. If we want to purchase more points directly through Disney, we have to wait to physically be in Florida to purchase. Otherwise, we can purchase through resale.

We receive most of the mailings and have actually added points twice after our move.

So, I don't see why there would be an issue to change your address.

However, I do believe you have to be a resident with ID showing your home address is in Alberta. We just provided our driver's licence as proof (if I remember correctly).

When you change your address, the service will be different. They will not be able to offer you prices or even speak to you about purchasing. We always had to be at the DVC centre in order to purchase more points. My guide always calls us when we vacation at the Disney resorts to check to see if he can offer us anything, because that's the only way he can. He cannot speak to us about anything in terms of purchasing, incentives etc while we're at home. But when we're at the resort, he can offer everything.

This has been our experience. If it has changed, then I'd love to hear about it. :)

Good Luck.
