Yesterday I was at the mall and saw photo albums, which I need, in a window display at Things Remembered. There was a big sign hanging that said something like "Save a Fortune",(big sale ad) and then on the table which had the photo albums, there was a plastic sign that said 75% off. I had no money on me, but went back today. Everything was still advertised the same way, 24 hours later. I went in looking for the albums and found nothing for 75% off. I asked the lady and she showed me the albums in the store, they were showing 50% off. I said "the sign in the window says 75% off?" She looked, took the sign away and said that "not everything is 75% off". Ummmmm ok? The only things near the sign were the photo albums.
So would you have expected 75% off?

Yeah, if the sign was over/with the albums, I would expect them to be 75% off.

No small print at the bottom of the sign?

I would have asked what exactly was 75% off. It is false advertising if they did not have anything.

I didnt see any small print, and the girl didnt point anything out on the sign.
Im not sure, but I assumed that some stuff in the store may have been 75% off, however the window display was only a table with the photo albums & the 75% off sign on it. To me that says the albums were 75% off.

I was shopping with a friend on the weekend and she found a sweater she liked that was regularly $69.98, marked down to $59.98. It was sitting on a table with a lot of sweaters and the sign on the table said sweaters 50% off. When she went to buy it, the sales woman told her that the one she wanted wasn't 50% off just some of the sweaters were. My friend put the sweater back, but when I found out why, I went to the other woman working, who I knew was in charge that day, and asked her about it. I pointed out that the sign didn't say up to 50% off, or 50% off selected items and she had to sell it at 50% off. I work in retail and have been caught by wrongly worded signs before. If it's advertised as being on sale at a certain reduction (and this includes being on a table with a sale sign on it) in this province, it has to be honoured. The only exceptions are if the item was placed there in error by a customer or if the label has obviously been tampered with. I would say that if the albums were on a table with a sign saying 75% off with no other excetions showing, then they really should be obligated to sell them at that price. You should have pursued this a little harder. Most stores don't want to tick off their customers, and would rather keep them happy by taking a slight loss on one thing so that they come back for others.

Thats what I thought. I know I should have pushed, but I figured I was lucky to get 50% off and didnt feel like fighting it. Plus taking DS into a store like that gets me nervous(I could very easily end up owing them a lot more, LOL!) The more I think about it, I wish I did say something. I was buying 2 of them so thats $12.00 I could have saved. Im curious if she put the sign back in the display though. If I see it there again then Ill know they are knowingly falsely advertising, and I will go back in and try to buy them again for cheaper.
