5 in room if one is a baby????

we are going to hh next month in a studio. my dw, myself, ds6 and dd1. we would like to take our nephew 8yrs. old to play with our son. I believe that this is legal due to the age of our daughter. Please let me know! I realize that we could get away with it, but would like to be legal!!

I spoke to ms this morning and was told that it is fine as long as 1 child is under the age of 3.
